Licensing Program Analyst (LPA) Daniel Pena conducted an unannounced inspection for the purpose of delivering the finding for the above allegation. LPA met with Director Joanne Winkle and after displaying his identification and explaining the purpose of the inspection was permitted entry into the childcare center.

On 03/25/2022, two children engaged in inappropriate behavior during nap time. The children’s actions occurred while a teacher was present in the room. Throughout the investigation, LPA conducted a facility tour, interviewed staff members, parents and children. LPA also obtained related documentation. Based on LPA's direct observations, facility record review and interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, Title 22, 101229(a)(1) is being cited on the attached LIC 9099D. Exit interview conducted and report was reviewed with Director Winkle. A notice of site visit was given and must remain posted for 30 days.

Based on LPA observation, record review and interviews with staff, parents and children, staff did not maintain visual supervision. This resulted in inappropriate interactions between children in their classroom. This poses a potential health and safety risk to children in care.
