On 09/23/2022 at 10:16am, Licensing Program Analyst (LPA) Samantha Clenista conducted an unannounced case management site inspection for the purpose to evaluate whether the licensed areas of this facility have any access to the swimming pool on site to ensure the health and safety of all children.

Upon arrival, LPA met with Director, Lauren Miller, and proceeded for the facility. There were no school-aged children present during inspection. The facility currently operates in the following rooms: Room 1 and 2. LPA toured all licensed areas and the pool area that is on site. LPA observed there to be a total of two swimming pools, 1 in ground wader pool and 2 jacuzzi’s. All bodies of water are located in one big open area behind the preschool building. The area where the bodies of water are located is enclosed via fence (mixture of chicken wire, mesh, vertical metal fencing). All fencing was observed to be higher of 5ft. One pool and one jacuzzi was separately fenced within the open area.

When LPA toured all licensed child care areas, LPA observed an enclosed playground area that the children were playing in during inspection that is fully fenced. The fence is constructed with wooden planks placed vertically and horizontally with little to no gap in between. Fencing measured over 5ft. surrounding the play area. LPA looked over the fencing and could not see the bodies of water in site. LPA reminded Director that direct visual observation of all children shall be maintained at all times during outdoor play. When LPA toured the classrooms, LPA observed there to be a total of three exits that lead to a side yard. Part of the side yard has walkway that has a chain link fence dividing the preschool area and the area where all the bodies of water are located. This chain link fence was measured at approximately 4ft. 10 inches from the ground, shy of the required 5ft. requirement. Fencing was also observed to be climbable.

Building and Grounds. Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view..gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. This requirement was not met as evidenced by;

Director stated she will discuss and provide her management team and board some options of how to make the fencing appropriately inaccessible to children. Director stated she will provide LPA with an update and decision no later than 10/10/2022.

LPA observed the chain link fence dividing preschool area and bodies of water to be climbable, less than 5ft. tall, and does not self-latch at all distances when opened. This poses a Potential Health and Safety risk to the clients in care.

There is a self-latching gate, however LPA tested the gate at multiple distances, and observed it to not close when it was pulled out about 2-5 inches away from the gate. LPA observed that this chain link fence does not meet regulation. It is climbable, less than 5ft. tall, and does not self-latch at all distances when opened. See 809D for cited deficiency. LPA took pictures and videos of the preschool area in relation to the various bodies of water. See file for pictures.

Exit interview was conducted with Director. LPA requested from Director an updated facility sketch showing a bird's eye view of the entire facility, specifically showing the bodies of water in relation to the child care areas. NOTICE OF SITE VISIT IS TO BE POSTED FOR 30 DAYS. LPA observed Director post notice of site visit.
