On 04/19/22 at 10:00AM. LPA Luigi Gargaro, conducted an unannounced complaint finding delivery visit to the facility regarding the above allegation. During the course of the investigation analyst conducted interviews with the reporting party, the facility director, staff members, children in care and day care parents.

From the evidence gathered, it was determined that during the period of February 3rd through February 9th the facility had three cases of Covid-19 occur in one classroom that were not reported as required by regulation to day care parents. While one of the cases was verbally reported to day care parents, the other two cases were not.

Based on LPA's observations and interviews which were conducted and record review(s) the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED, California Code of Regulations, (Title 22, Section 101212(f)) and is being cited on the attached LIC 9099D.

An exit interview was conducted and the report was reviewed with facility director Anita Castro. A copy of this report, along with Appeal Rights (LIC9058 01/16), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Director states she understands the requirement to report any epidemic outbreak that occurs at her facility to the representatives of all children in care and will ensure that she meets this requirement at all times going forward. Director states she will submit a written statement to analyst attesting the same by 04/22/22 to correct the deficiency.

Based on LPA’s records review and interview with the facility director, the licensee did did not report an epidemic outbreak in a facility classroom to day care children’s parents and/or authorized representative, which poses a potential health and safety risk to children in care.

On 04/19/22 at 10:00AM. LPA Luigi Gargaro, conducted an unannounced complaint finding delivery visit to the facility regarding the above allegation. During the course of the investigation analyst conducted interviews with the reporting party, the facility director, staff members, children in care and day care parents.

From the evidence gathered, it was determined that though during analyst’s visits to the facility children and staff were properly masked, it could not be conclusively proved or disproved that this was always previously the case or that the facility was strictly following all additional masking guidelines at all times. Though the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

An exit interview was conducted and the report was reviewed with facility director Anita Castro. A copy of this report, along with Appeal Rights (LIC9058 01/16), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
