Licensing Program Analyst (LPA) Liliana Silveira conducted an unannounced complaint investigation visit. LPA Silveira introduced themselves, met with Caregiver Isabel Sanchez and disclosed the purpose of the visit. The purpose of the visit was to deliver complaint findings for the above-mentioned allegations.

The Department’s investigation consisted of interviews, a facility records review and observations. It was alleged that chemicals were left accessible to residents. Observations from two visits conducted in January 2021 and December 2024 revealed that toxic chemical and cleaning supplies are locked in a cabinet outdoors. Interviews with clients who have resided at the facility since 2021 also revealed that no clients have observed chemicals being left around the facility. Interviews with two outside sources revealed that they have never observed chemicals being left out around the facility. There was insufficient evidence to support this allegation. It was also alleged that staff did not arrange transportation to a doctor’s appointment for Client #1 (C1). An interview conducted on 01/21/2021 with C1 revealed that C1 confirmed that no medical appointments had been missed and C1 also confirmed that they receive assistance from the Licensee and outside sources for transportation. Interviews with clients who resided at the facility since January 2021 also revealed that there were no issues regarding clients getting transportation assistance to doctors appointments. Interviews with two outside sources also revealed that there were no concerns regarding clients getting assistance with transportation. The Department attempted to interview staff who worked at the facility during January 2021, but was unable to reach them. There was insufficient evidence to support this allegation.

It was also alleged that the facility did not seek medical care for C1. The Department interview with C1 conducted on 01/21/21 revealed that C1 did not recall having to seek medical care during that month. An interview with an outside source and the Administrator also revealed that there was no recollection of medical care being needed for the client in January 2021. Interviews with outside sources, as well as other clients who have resided in the facility since 2021, revealed that there are no concerns regarding clients getting medical care when needed. The Department attempted to interview staff who worked at the facility during January 2021 but was unable to reach them. There was insufficient evidence to support this allegation.

Due to a lack of corroborating evidence, the allegations that: chemicals were accessible to residents, staff did not arrange transportation to a doctor's appointment and that the facility did not seek medical care for a client are unsubstantiated. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations occurred, therefore the allegations are unsubstantiated.

LPA Silveira conducted an exit interview with Isabel Sanchez. At the time of the exit interview Isabel was provided with a copy of the Complaint Investigation Report (LIC9099) and Licensee Rights (LIC9058 03/22). The signature on this report acknowledges receipt of the rights.
