32 | An interview with the Licensee revealed the electrical bill was consistently paid and up to date, however the facility was experiencing issues with their electrical panel causing intermittent outages in certain areas of the facility. The Licensee used alternative means to keep the facility operational. A facility tour revealed a back up refrigerator the perishable food had been transferred to, and emergency lighting if needed. The Licensee also revealed the outage was intermittent and only in certain areas of the facility.
It was also alleged the facility did not have a landline available to clients in care. This was also due to technical issues beyond the Licensee's control during trying times. The Licensee revealed she allowed clients to use her personal cell phone if needed but most of the clients have their own phones. At the time COVID-19 made appointments to have an electrician come out to the facility difficult. On approximately June 1, 2020 the Licensee was able to have electricians come out and fix the panel. Since then the facility has never experienced another electrical issue.
An interview with an outside source corroborated the facility had electrical issues, and the Licensee had the entire panel replaced two weeks prior. The outside source revealed the current electrical outage was due to a technical issue from the new installation in the left side of the panel that caused the outage. The outside source corroborated that on June 1, 2020 two electricians went to the facility and fixed the issue. A record review revealed no gaps in services due to non-payment, and proof of payment to the electricians was provided. In regards to the allegation regarding the Licensee failed to notify Licensing intent to terminate electricity, interviews with facility staff, outside sources and a record review the Licensee never intended to terminate the facility's electricity, and the electricity was intermittent and only in certain areas due to a technical issue.
Due to lack of corroborating evidence, the findings regarding the above allegations were established to be unsubstantiated. This finding means although the allegation may have happened or could be valid, there is not a preponderance of evidence to prove that the alleged violation occurred.
LPA Correia conducted an exit interview with Licensee Legaspi. After the conclusion of the exit interview Licensee Legaspi was emailed a copy of the Complaint Investigation Report (LIC9099) and Licensee Rights (LIC9058 01-2016), and reply response via email confirms receipt of the reports. |
