32 | On today’s date, LPA arrived at the facility to investigate the allegation and conducted a full tour of the inside and outside areas. Inside the facility, the LPA found all communal living areas, bathrooms, the kitchen, and the garage to be clean, organized, free of foul odors, and free of blockage in any walkways. The facility temperature was comfortable, and there were no signs of unsanitary or unsafe conditions indoors.
LPA then toured the backyard and observed the area to be clean, with no animal feces present anywhere in the yard. The LPA observed a cat with her kittens nursing inside a large covered cage, a husky inside another large covered cage, and a parrot inside a large cage. All animals observed had access to food and water at the time of inspection. The cages appeared appropriately sized, and no odors or sanitation issues were noted in the backyard.
LPA interviewed C1, who stated that the cats and the husky belong to them. C1 stated they recently contacted an outside party to assist with spaying and/or neutering their cats but reported that the outside party removed some of their cats without their knowledge or permission. C1 stated they clean the cat litter box and the cage area once a week and explained that the cats are usually out of the cage but go inside to nurse with the mother. C1 also stated that the husky is normally loose in the yard but was placed in the cage so the dog would not jump on the LPA upon arrival. C1 stated the parrot belongs to the Licensee and is given fresh food and water daily.
LPA also interviewed an outside agency (OA) that had previously investigated the same concerns. OA reported that their findings were unfounded. OA stated that although the facility had several “community cats” in the area, the facility only owned a few cats. OA reported no concerns regarding the animals’ food, water, or cleanliness. OA stated that facilities are permitted to kennel their pets in the backyard. OA found the female husky to be bright and alert, and the parrot to be in normal condition. OA reported no unsanitary conditions or odors in the backyard during their visit.
Based on today’s inspection, interviews with C1, and the outside agency’s findings, there is not enough evidence to support the allegation that staff are not providing sanitary living conditions for clients in care. The LPA did not observe any unsanitary conditions or signs of animal neglect, and the outside agency’s findings were consistent with the LPA’s observations. The allegation is unsubstantiated. An exit interview was conducted with Emerita Garcia.
