Specifically, the complaint alleged that R1 was informed by facility staff via FaceTime that the facility would not be able to hold R1's room beyond seven days while R1 was hospitalized. An LIC 811, Confidential Names List, was provided to the facility to identify R1.

On July 30, 2026, prior to receipt of the complaint, R1 was involved in a physical/aggressive altercation with a roommate. Facility staff responded to the incident, intervened, and successfully de-escalated the situation. Due to R1's assessed medical needs, staff obtained emergency medical assistance, and R1 was transported to a higher level of care facility for further medical evaluation and treatment.

The facility self-reported the July 30, 2026, incident to CCL on July 31, 2026, through an LIC 624, Unusual Incident/Injury Report. Review of the LIC 624, R1's daily progress notes, and other related facility records indicated that the incident did not result in serious injury to either resident. The documentation indicated that facility staff responded to the incident and sought appropriate medical intervention for R1.

Review of the LIC 624 and related records did not disclose evidence of a Title 22 violation associated with the facility's response to, or reporting of, the July 30, 2026, incident. R1's responsible party was also notified regarding the incident as documented by the facility.
Review of R1's admission's agreement indicated R1 was admitted to the facility on April 23, 2026. In addition, R1's physician's report indicated that R1 had medical and behavioral conditions requiring ongoing assessment, care, and supervision. Facility records also documented a history of aggressive behaviors involving staff and/or residents. This information was considered in evaluating the facility's actions following the July 30, 2026, incident and R1's hospitalization.

On August 6, 2026, facility staff conducted a reassessment of R1 while R1 was hospitalized. Staff reported that R1 had not returned to their baseline and that R1's presentation and condition required further evaluation before R1 could safely return to a shared room. During interviews, facility staff indicated that they continued communicating with R1's medical team and care management team to determine the appropriate plan for R1's safe discharge and return to the community. LPA review of emails and texts between facility staff and the medical team confirmed the on going communication.

Interviews with facility staff were consistent in stating that the facility did not issue R1 or R1's responsible party a written eviction notice and did not intend to evict R1 from the facility. Staff stated that they were working with R1's medical and care management teams to establish a safe discharge plan and determine the appropriate accommodations necessary for R1's return to the facility.

Title 22, California Code of Regulations, Eviction Procedures, establishes requirements governing the eviction of residents from an RCFE. The regulation requires a licensee seeking to evict a resident to follow the applicable eviction procedures, including providing the required written notice and identifying the basis for the eviction. The investigation therefore considered whether the facility's actions during R1's hospitalization constituted an eviction or an attempt to circumvent the required eviction procedures.

Review of facility records and interviews did not establish that the facility initiated an eviction pursuant to Title 22 regulations. Specifically, the investigation did not disclose evidence that the facility issued R1 or R1's responsible party a written eviction notice, terminated R1's admission agreement, or permanently refused to readmit R1 to the facility.

The investigation did consider the allegation that facility staff informed R1 that the facility would not hold R1's room beyond seven days while R1 was hospitalized. However, the totality of the evidence did not establish that this communication constituted an eviction or that the facility terminated R1's residency. Review of communications between facility staff and outside sources from August 5, 2026 through August 17, 2026 documented numerous communications concerning R1's medical condition, discharge planning, room arrangements, and efforts to safely return R1 to the facility.

On August 17, 2026, R1 was discharged from the higher level of care facility and returned to the facility. Upon R1's return, R1 was placed in a private room based on R1's assessed needs. The facility's service care plan was adjusted to address R1's current care and supervision needs. Facility staff continued to monitor R1 and provide care and supervision to meet R1's needs and maintain the health and safety of R1 and the other residents.

During an interview on August 20, 2026, R1 stated that they were very happy at the facility and did not express concerns regarding the care or services being provided. R1 stated that facility staff provided and met their needs with activities of daily living. R1 was observed in the activity room watching television with other residents. R1 appeared appropriately dressed, and no visible signs of physical abuse, neglect, or injury were observed.

An interview with R1's responsible party did not disclose concerns that facility staff failed to meet R1's care needs or that R1 had been permanently removed or evicted from the facility.

The investigation established that following the July 30, 2026, incident, facility staff arranged for R1 to receive a higher level of medical care, reassessed R1's needs, communicated with R1's medical and care management teams, and worked toward a safe discharge plan. The evidence further established that R1 was accepted back into the facility and returned on August 17, 2026. Upon return, R1 was provided a private room and the service care plan was adjusted to address R1's assessed needs.
Although the complaint alleged that R1 was informed that the facility would not hold the room beyond seven days during the hospitalization, the investigation did not establish that the facility permanently terminated R1's residency, issued an eviction notice, or otherwise evicted R1 from the facility. The subsequent return of R1 to the facility on August 17, 2026, further demonstrated that the facility had not permanently terminated R1's placement.

Based on facility observations, interviews, records review, and information obtained from outside sources, the investigation did not produce sufficient evidence to establish that the facility unlawfully evicted R1 or circumvented the eviction procedures required under Title 22, California Code of Regulations.

The preponderance of evidence standard was not met. Therefore, the allegation of Unlawful Eviction is deemed Unsubstantiated.

An exit interview was conducted with Administrator Meera Kharbanda. A copy of this report, LIC811 and the Licensee Appeal Rights (LIC 9058, 03/22) were provided to the licensee at the conclusion of the visit.
