On 06/20/25 Licensing Program Analyst (LPA) Javina George made an unannounced visit to the facility to deliver findings for the allegation listed above. LPA met with Licensee Manuel Vazquez and explained the purpose of the visit, and the elements of the allegations. The investigation consisted of observations, interviews, and record review. The department received a complaint on 03/28/2022, alleging a staff member hit a client. A video surfaced on 03/28/2022, displaying an act of physical abuse to Client 1 (C1). It is unknown the date the video was taken.

Regarding the allegation of Staff member hit resident.The video takes place in the backyard on the deck/patio. The video depicts three (3) individuals involved, 1 client and 2 staff. The (2) staff and C1 are seen standing in the middle of a wooden deck. There is a third staff standing out of the sight of the camera. Staff 1 (S1) is standing to the right of C1. S1 is holding a plastic cup filled with water and proceeds to throw the water in C1’s face, who is standing in middle of the screen. Staff 2 (S2) who is seen standing behind and to the left of C1, is observed wearing a black boxing glove on their right hand. S2 then hits C1 to the right side

of their face. C1 is then observed to fall sideways to the ground following the force of the hit to the face. S2 is observed laughing after hitting C1 in the face.

The licensee was shown the video on 03/30/22, and the licensee identified the three staff involved in the video as well as the client. The licensee identified the third staff as Staff 3 (S3) who is filming the incident. The video was edited to be shown in slow motion. On 04/04/2022, S2 was arrested and charged with PC 368-Dependent Adult Abuse and PC 245 (a)(4) - Assault by Means Likely to Produce Great Bodily Injury. S2 and S3 plead guilty to felony counts of PC 368. S1 plead guilty to a felony count of 368(b)(1).

Based on review of the video, interviews conducted and records review, the preponderance of evidence standard has been met. Therefore, the allegations of staff hitting client and failing to treat client with dignity and respect is found to be SUBSTANTIATED. A finding that the complaint is substantiated means that the allegation is valid because the preponderance of the evidence standard has been met. California Code of Regulations (Title 22, Division 6 & Chapter 3) are being cited on the attached LIC 9099D).

An exit interview was conducted and a copy of this report, 9099D, appeal rights, and LIC811-confidential names list were reviewed and provided to Licensee/Administrator Manuel Vasquez.
