Licensing Program Analyst (LPA) Ramon Serrano conducted an unannounced complaint visit to deliver findings on the above allegation. LPA met with Resident Services Director Richard Mariona and we discussed the purpose of the visit and elements of the complaint.

Community Care Licensing (CCL) has investigated the above allegation. The investigation consisted of LPA direct observation, records review, interviews with facility staff and resident responsible party.

It was alleged that on or around January 2022, licensee and facility staff were not allowing visitors.

On January 27, 2022 an interview with Executive Director (ED) revealed she had been the ED for approximately ten months and although they (Somerford Place Encinitas) still had the Adult Day Program (ADP) license, the ADP had been closed for approximately two years.

Interview with resident family member on November 18, 2022 revealed their family member was admitted to the facility in January 2020 and it was known that the Adult Day Program was closed at that time.

Interview with new Executive Director (ED) on November 18, 2022 revealed the Adult Day Program (ADP) re-opened on October 2022.

Records review revealed that from January 2022 through October 2022 the ADP did not have any clients listed on their roster.

Based on LPA observations, interviews, and facility records, we have found that the preponderance of the evidence standard has not been met, therefore, the allegation is found to be unsubstantiated.

An exit interview was conducted with Richard Mariona_and a copy of this report and Licensee/Appeal Rights (LIC 9058) were provided to Richard Mariona whose signature below confirms receipt of documents.
