Licensing Program Analyst (LPA) Dang Nguyen conducted an unannounced subsequent visit to deliver findings regarding the above prior complaint allegations. LPA was welcomed by, identified himself to, and discussed the purpose of the visit with Licensees Raquel Preece and Derek Hampton.

The Complainant alleged that Licensee did not maintain continuous supervision of client(s), that Licensee did not protect Client #1 (C1) from bullying by peer Client #2 (C2), that Licensee did not assist C1 with transport to medical appointment, and that Licensee did not meet C1’s personal rights regarding visitation. [See LIC811 Confidential Names List for a description of select person identifiers used in this report.] CCLD’s investigation involved unannounced facility tours/welfare check and review of pertinent care documents and correspondence. The Department also interviewed all clients and multiple relevant staff and outside sources.

It was claimed that lapse in supervision occurred because direct care Staff #1 (S1), who was the only staff present at the time, was sleeping on the job because S1 took too long to respond to and open the front door during two dates in early February 2025. However, investigation showed that the Complainant did not witness S1 sleeping. In their own interview, S1 denied sleeping on the job, and said they responded to the front door timely. Interviews of all four (4) clients who lived at the facility, plus multiple coworkers of S1, aligned to show: None of these persons ever seen or heard about S1 sleeping on the job. On the contrary, clients overwhelmingly said that S1 was immediately aware of their movements and responsive to their needs whenever they came out of their bedrooms. Interview of San Diego Regional Center (SDRC) personnel showed they had no suspicion concern that facility staff were sleeping on the job (or took too long to answer the phone or front door), instead saying staff were “very responsive.”

Client and staff interviews generally aligned to show: On or around 02/11/2025, Licensees purchased a pizza for clients to share. C1 stood near the pizza and double-dipped their food into a sauce that was to be supposed to be shared by multiple clients. C2 made a comment on this and chastised C1 to save some food for other clients to eat. Client #3 (C3), meanwhile, encouraged C1 to sit down so that C1 could eat comfortably. Shortly after, C1 left and walked upstairs to their bedroom. C1 told CCLD that C2 did not say anything further to them, and they simply went their separate ways. C3 told CCLD that C2 did call C1 some names as C1 ascended the stairs, but also that the staff who was on duty quickly intervened to put a stop to that behavior.

Interviews showed that on other dates: C1 and C2 each sometimes engaged in disrespectful name calling towards each other (i.e., it went both ways). C3 sometimes called C2 names, but did not do this to C1. However, whenever staff heard name calling, they quickly redirected/corrected the clients. All clients in care said despite occasional interpersonal spats, the four of them remained socially compatible overall. Each client strongly denied feeling bullied or harassed by any peer, denied feeling uncomfortable living with any peer, and denied wanting to live elsewhere. SDRC performed is own independent investigation of this allegation, interviewing the Compliant, client, and staff, finding there was no evidence of bullying or an untenable situation.

It was claimed that on 01/13/2025, Person #1 (P1) text messaged Licensee asking if facility staff could help transport C1 to a psychiatry appointment to occur on 01/17/2025 (an appointment which P1 made on behalf of C1). LPA reviewed of the text messages from each party (with their permission), respectively; they matched. The texts showed Licensee immediately replied asking where and at what time the appointment would be. However, P1 did not provide this information to Licensee. Interviews of both parties confirmed that at that time, P1 was the only person who knew when and where the appointment would be, because they had not given Licensee access to C1’s online healthcare portal. Ultimately, Person #2 (P2) (not a staff) transported C1 to the appointment, which was not missed. Interviews of staff and clients did not yield evidence of facility staff refusing or failing to transport clients to medical/dental appointments; on the contrary these persons said Licensee was generally eager to help with transportation.

It was claimed C1’s visitation rights were violated because Licensee required P1 and P2 to give 24-hours advance notice before visiting C1 at the facility. Interviews and records showed Licensee indeed requested this of P1 and P2. C1 told CCLD that they feared P1 and P2 would come to their bedroom to collect their belongings when they were not present and without their consent, to forcibly move C1 from the facility (a facility which C1 liked living at). C1 said that P1 had prior threatened to do this. Interviews of staff and all clients, corroborated by SDRC records and correspondence, aligned to show: P1 and P2 on multiple prior occasions had come to the facility and disrupted the peace of not only C1, but also their housemates. P1 had also spoken harshly to C1 during phone calls. The conduct was severe enough that a court-appointed investigator wrote it constituted “mental and emotional abuse.” Licensee’s request that P1 and P2 both give 24-hours advance notice before visiting C1 was thus not a violation of C1’s personal rights. Rather, it was aligned with protecting C1’s personal rights and was consistent with C1’s own wishes, which C1 themselves memorialized in writing. Interviews of other clients in care showed each of those persons had no problems/complaints regarding their own ability to receive visitors at the facility.

Based on records and interviews, a preponderance of evidence does not exist to show that Licensee did not maintain continuous supervision of client(s), that Licensee did not protect client from bullying by peer, that Licensee did not assist client with transport to medical appointment, and that Licensee did not meet clients’ personal rights regarding visitation. These four (4) allegations are therefore Unsubstantiated, and no deficiencies were cited for them.

An exit interview was conducted with Licensees Raquel Preece and Derek Hampton, to whom a copy of this report and the Licensee/Appeal Rights (LIC9058 03/22) were provided.
