Licensing Program Analyst (LPA) Esther Miller conducted an unannounced visit to commence a complaint investigation. LPA was granted entry after identifying herself. LPA discussed the purpose of the visit and the basic element of the allegation mentioned above with Cindy Pedrero, Supervisor.

On July 21, 2023, it was alleged that staff’s behavior did not accord dignity to clients. Specifically, it was alleged that staff yelled in front of clients and escalated a disagreement. The Department’s investigation consisted of review of facility records, outside source records, and interviews of facility staff and outside sources.

Supervisor stated that the facility does not employ any bus drivers and all transportation for clients are done through their responsible parties. Any bus transportation was owned by a third-party company and

not associated with the facility. Outside sources, staff, and Supervisor stated that, typically, a bus arrived around 1PM, Monday through Friday, to pick up clients. It is normal for the bus to be parked in front of the facility since there were no assigned parking spaces for the bus. LPA observed that the facility was in a small, but busy, shopping center. The area directly behind the facility was mostly empty but was not assigned to facility for use. In front of the facility, there was a row of parking spaces perpendicular to the facility. Directly next to the facility, are two business.

On July 20, 2023, interviews with outside sources, Supervisor, and staff stated that a person, who had no ties to the facility, requested the facility to move the bus that was blocking their car. According to witnesses, the person and the Supervisor began to argue. Staff indicated that clients were kept away from argument, and Supervisor and outside sources stated that the argument took place outside of the facility. Outside sources close to clients stated that clients did not arrive from the day program agitated or with maladaptive behaviors. LPA attempted to speak to clients at the day program but was not able to get statements.

Based on the evidence obtained during the complaint investigation, the allegation that staff’s behavior did not accord dignity to clients is found to be UNSUBSTANTIATED, meaning that although the allegation may have happened or may be valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. An exit interview was conducted with Supervisor; a copy of this report and Licensee's Rights (LIC9058) were provided.
