Licensing Program Analyst (LPA) Iby Strong conducted an unannounced visit to deliver findings in the above complaint allegations. LPA identified herself and discussed the purpose of the visit with Caregiver Lucina Chavez. Administrator Froilan Montes arrived shortly after.

On March 22, 2022, Community Care Licensing (CCL) received a complaint alleging Staff 1 (S1) pushed Client 1 (C1) resulting in injury, staff did not seek timely medical care for C1, staff did not prevent multiple clients from engaging in inappropriate behaviors and staff are not providing a comfortable environment for clients.

During investigation, LPA Strong collected outside source records, facility client records and conducted interviews. Based on C1 records, C1 is diagnosed with a traumatic brain injury, anxiety disorder and a major neurocognitive disorder. Additional records revealed C1 has a history of verbal and physical aggression towards staff and clients.

According to allegation, on March 21, 2022, C1 was injured during a physical altercation between C1 and S1. According to records, S1 opened C1’s bedroom door and C1 fell back into personal items. Interview with clients present on the date of the incident did not corroborate that S1 hit C1 with hands. Interviews revealed that S1 opened C1’s bedroom door and C1 was hit by the door. Interview with Administrator revealed there were no other witnesses present during date of the incident.

It was also alleged that staff did not seek medical care for C1 after March 21, 2022, incident with S1. Based on outside source records, C1 had small scratches to arms. During investigation there were no corroborating medical records available to show that C1 needed medical assistance after incident.

Additionally, it was alleged that staff did not prevent clients from engaging in inappropriate behavior. According to allegation, Client 2 (C2) was often allowed to be inappropriate with staff and clients. Records reviewed revealed C2 is diagnosed with schizophrenic disorder and is bipolar. Interview with staff revealed that C2 was often redirected away from other clients but did have physical incidents with staff. Interviews revealed that emergency personnel were contacted to deescalate C2 often. It was also alleged that C3 and C4 had an incident between each other that was not appropriate. Records revealed that C3 was diagnosed with schizophrenic disorder. Interview with C4 revealed that C3 physically attacked C4 and staff attempted to separate clients but emergency personnel were ultimately contacted. Interview with Administrator corroborated that C3 had a manic episode and C4 was the victim. Based on information provided, facility staff provided emergency assistance and care to C4. Interviews with staff revealed that they often deescalate events between clients and contact emergency personnel when necessary.

Lastly, it was alleged that staff are not providing a comfortable environment for clients. According to allegations, clients are not comfortable with the other clients present at the facility. Interviews with multiple clients did not corroborate that they are not comfortable living at the facility. Interview with outside source did not reveal any issues reported with clients not having a comfortable living environment.

Based on LPA's interviews, and record reviews there is not a preponderance of evidence to prove alleged violations occurred, therefore the allegation is unsubstantiated. An exit interview was conducted with Administrator Froilan Montes, to whom a copy of this report, and the Licensee/Appeal Rights (LIC 9058 03/22) were provided.
