Outside sources interviewed did not express concern regarding the Licensee's physical care of residents. Outside sources further revealed that external investigations were conducted with no findings of physical abuse or neglect by staff.
Records review revealed that the the licensee reported the incident to the Department within the required timeframe, which included proof of an internal investigation regarding the event. Records review showed no corroboration and did not produce evidence that the event occurred. Outside source investigation documents did not indicate that the event occurred or that there was evidence to support the allegation.
Due to their baseline memory loss, R1 was unable to participate as a reliable historian/interviewee about the incident.
Based on interviews, direct LPA observations and records review, a preponderance of evidence does not exist to prove that the alleged violation occurred, therefore the allegation is UNSUBSTANTIATED. An exit interview was conducted with Executive Director Sam El Rabaa, to whom a copy of this report and the Licensee/Appeal Rights (LIC9058 03/22) were provided. |
