32 | Interviews revealed that only one elevator would be out of service at a time. Interviews revealed that there were a lot of residents moving into the facility and the facility began reserving one elevator for movers use only. During those times, a sign would be placed on the elevator that it was being used for movers and would not be available for use. During a visit on September 27, 2022, LPA Ruiz observed both facility elevators in operation, with one elevator being used for a resident move-in. The elevator being used for the resident move-in had a sign on the call button notifying residents that it was being used by movers. The other elevator was available for resident use during the LPA’s visit. Interviews with the Maintenance Director revealed that the facility contracted with an elevator maintenance company for regular preventative maintenance and the facility maintenance staff conducted monthly inspections and weekly elevator track cleaning. The Maintenance Director stated that there was one weekend in September 2022 where one of the elevators was out of service beginning on a Friday and an elevator technician was not able to service the elevator until that Sunday. During that time period, the other elevator was working and available for resident use and the facility provided residents with complimentary room service for meals. Review of elevator maintenance invoices revealed that the facility contract for regular elevator maintenance covered from July 21 to December 31, 2022. Additionally, the facility contacted the maintenance company on August 17, September 18, and September 22, 2022, for issues with the elevators not working properly. Review of those invoices revealed that the elevator company was able to respond to those service requests on the same day or within 24 hours. Interviews revealed that there have not been any issues with the elevators for a few months.
The Department has investigated the above-mentioned allegation and based on observations, record review, and interviews, the preponderance of the evidence has not been met, therefore, this allegation is deemed unsubstantiated.
