13 | Licensing Program Analyst (LPA) Carmen Lopez conducted an unannounced complaint visit to open a complaint investigation regarding the above-mentioned allegations and delivered findings. LPA identified herself and was granted entry by Brenda Guzman, Receptionist. LPA stated the purpose of the visit and reviewed the findings of the complaint with Executive Director, Sam El-Rabaa.
The Department’s investigation consisted of LPA’s observation of the facility grounds and interview with the Executive Director. On December 20, 2022, it was alleged that the facility did not post the Community Care Licensing poster in the main entryway of the facility. It was also alleged that the facility Ombudsman poster is not visible to the residents.
It was reported that the facility did not have the Community Care Licensing poster posted at the main entryway of the facility. LPA spoke with Executive Director Sam El-Rabaa who said that the facility has the Community Care Licensing poster posted down the hallway. During a tour of the facility on December 23, 2022, LPA observed a Community Care Licensing poster (PUB 475) posted near the main entrance down a main hallway of the facility. Based on observations and interview with the Executive Director, there is insufficient evidence to support the allegation.
It was also alleged that the Facility’s Ombudsman poster was not visible to the residents. LPA spoke with Executive Director El-Rabaa who said that the facility has the Long-Term Care Ombudsman poster posted in the activity room. During a tour of the facility on December 23, 2022, LPA observed one Long-Term Care Ombudsman poster posted in the residents’ activity room located on the first floor. Based on observations and interview with Executive Director El-Rabaa, there is insufficient evidence to support the allegation.
Based on the Department’s investigation of the above-mentioned allegations and the evidence obtained during LPA observations of the facility grounds, there is insufficient evidence to meet the preponderance of evidence standard. Therefore, the above allegations are deemed to be unfounded.
The report was discussed, and an exit interview was conducted with Executive Director, Sam El-Rabaa. A copy of this report along with Licensee/Appeal Rights (LIC9058 03/22) was provided to Executive Director El-Rabaa at the conclusion of the visit.
