Licensing Program Analyst (LPA) Vicky Williamson conducted a complaint visit to deliver findings on the above allegations. LPA was greeted and granted entry into the facility by Activity Assistant/Caregiver Gloria Ramierez. LPA met with Administrator Genoveva Guerrero and discussed the purpose of the visit.

The Department’s investigation consisted of a tour of the facility, a review of facility and resident records, interviews with staff, residents, responsible parties, and outside sources. It was alleged that staff do not assist residents with bathing. Information received indicated that Resident 1 (R1) was observed at the facility (date unknown) with greasy hair and a body smell. Interviews with staff revealed that all residents at the facility are assisted with showering. Staff stated that showers are provided twice weekly on the resident’s assigned date and as needed. Staff interviewed stated that the only time a resident would not be provided a shower would be if the resident refused or requested to take their shower later in the evening. Staff stated that they always make multiple attempts to encourage the resident to take their shower.

Residents interviewed revealed that staff assist them with showering. Resident Representatives interviewed did not disclosed concerns regarding showering. LPA was unable to conduct an interview with Resident 1 (R1). A review of records for the month of September 2022, October 2022 and November 2022 noted that showers were provided on R1’s assigned dates.

It was alleged that facility does not provide activities for residents. An interview with Activity Director Magdalena Garcia revealed that activities are provided at the facility daily for residents. A review of the activity calendar for the month of October 2022 and November 2022, displayed daily activities Monday – Sunday, from 9:30 am to 3:30 pm. Per Activity Directory, participation is encouraged from all residents, however some of the residents do not like to participate. Interviews with additional facility staff indicated that activities are provided to the residents daily and that they really enjoy participating and engaging in the activities.

Residents interviewed stated that they enjoy the activities at the facility. Some residents shared their favorite activities with LPA Williamson.

During the visits of LPAs to the facility during the month of October 2022, residents have been heard and observed participating in activities with staff. On 10/20/22, while sitting in the Administrator’s office, LPA Patterson could hear the activity coordinator playing a movement game with the residents, encouraging their participation. On 10/24/22, LPA Williamson observed the residents finishing a balloon toss activity with Staff 1 (S1). LPA was advised that the activity assistant was absence and S1 filled in. On 11/03/22, LPA Williamson observed the residents in the lounge area participating in chair yoga with Activity Directors Magdalena Garcia and Kelly Ajdukovich.

Interviews with the residents' representatives revealed no concerns regarding the activities at the facility.

The Department has investigated the above-mentioned allegations and based upon evidence obtained during interviews and records reviewed, it is determined that there is insufficient evidence to prove that the allegations occurred. Therefore, these allegations are deemed unsubstantiated. An exit interview was conducted with Administrator Genoveva Guerrero, to whom a copy of this report and the Licensee's/Appeal Rights (LIC9058 01/16) were provided to Administrator.
