Licensing Program Analyst (LPA), Tiffany Holmes, conducted an unannounced visit to initiate a complaint investigation regarding the above mentioned allegations. The LPA was greeted by Marcie Law, Administrator. The LPA indentified herself, was granted entry to the facility, and disclosed the purpose of the visit.

During the visit, the LPA conducted a tour of the facility, conducted interviews, and secured pertinent records. It was alleged that the staff do not have current first aid cards. LPA observed and made copies of several first aid cards that were all current and up to date. Interviews revealed that the three new staff that are newly hired do not have their first aid cards but they are in training and shadowing other staff at this point and they are not being left alone with the clients.

It was also alleged that staff do not have required physicals with a TB test. Interviews revealed the staff are required to go to the doctor after hire to complete a health screening report along with TB test. Staff files reviewed had these forms in their file. Interviews revealed that after the staff are hired the administrator provides them the health screening report and once completed the staff will bring it back and they file it. Interviews revealed these forms are given in the pre hire packet and the staff cannot start work without them.

It was also alleged that staff are financially abusing the clients. Interviews revealed they used to have Taco Tuesday but changed that to Fast Food Tuesday which is always Jack n the Box. The clients fill out a sheet each month stating they want Jack in the Box for the the month and the total is $5.00 each week. They also have the choice of going to the coffee shop for $5.00 and a Yoga/Stretch class for $5.00. The clients bring the $5.00 in the Friday before the Tuesday they participate on. Interviews revealed the clients are able to get a hamburger, cheese burger or nuggets with fries and a drink. Interviews revealed the administrator usually pays the balance if the clients don't have enough or did not bring money and decided to participate. There is a set order and price. Interviews revealed the is change minimal and that stays in the slush fund. Its 21 cents and all the change goes into an envelope and that change is used for hot cocoa for the clients, or a pizza party on a Friday, really what ever the clients vote for. Interviews revealed not all clients participate in the Jack in the Box meal, some bring their own lunches from home.

The investigation did not produce supporting evidence or supporting witness statements to substantiate staff do not have current first aid, staff do not have required physicals with a tb test and staff are financially abusing the clients. Based on the evidence obtained from interviews, and record review, the complaint allegations are unsubstantiated.

An exit interview was conducted with Marcie Law, Administrator and a copy of this report along with Licensee/Appeal Rights (LIC 9058 03/22) was provided at the conclusion of the visit.
