Licensing Program Analyst (LPA) Tiffany Holmes conducted an unannounced visit to close out the complaint investigation. LPA introduced herself, was granted entry, and met with Akram Askar, Staff, to whom she disclosed the reason for the visit.

LPA conducted interviews and obtained and reviewed pertinent records. It was alleged the facility does not have sufficient staffing to meet the residents' needs. Interviews revealed the staffing at the facility is usually 2-3 staff plus the administrator daily. Interviews with outside sources stated that when they conduct the visits at the facility there has been 2-3 staff there. Interviews revealed the administrator comes daily and assists with duties around the facility as well as being hands on with the clients. Interviews with outside sources did not reveal any issues with sufficient staffing to meet the clients' needs

It was alleged that the facility is operating out of ratio. Interviews revealed the San Diego Regional Center (SDRC) defines their ratio being one staff to three clients. Interviews revealed there are 2-3 staff at the facility with the clients. Interviews revealed there were 5 clients at the time the complaint came in and there were enough staff to keep the clients safe and supervised. Interviews with outside sources did not reveal any issues with facility operating out of ratio.

It was alleged that staff did not provide a safe and comfortable environment for residents. Interviews revealed the staff provide a safe environment for the clients by supervising them, keeping them safe, having activities for them to do and by being alert and there. Interviews revealed the temperature has been comfortable within the range of regulations each time LPA has made a visit. There is food and the clients are comfortable at the facility with staff. Interviews revealed when a client is having a behavior, one staff will stay with that client while the other staff tends to the other clients to keep them safe and out of harms way. Interviews revealed this is a 4I facility and mostly all clients have behaviors and the staff are equipped to handle clients with behaviors. Interviews with outside sources revealed they have not seen any issues where the clients weren't provided a safe and comfortable environment

It was alleged that staff retaliated against resident's responsible party for filing a complaint. Interviews revealed that the Reporting Party (RP) was never known by staff but they could only assume who the RP was. Interviews revealed that anybody can make a complaint and that is their right to do so. Interviews revealed that staff continued to care for the clients. There were no other complaints from outside sources regarding staff retaliated against resident's responsible party for filing a complaint.

The above-mentioned allegations of facility does not have sufficient staffing to meet the residents' needs, facility is operating out of ratio, staff did not provide a safe and comfortable environment for residents and staff retaliated against resident's responsible party for filing a complaint are unsubstantiated. The allegation may have happened or is valid, but there is not a preponderance of the evidence to prove that the alleged violation occurred.
An exit interview was conducted with Akram Askar, Staff and a copy of this report along with Licensee/Appeal Rights (LIC 9058 03/22) was provided at the conclusion of the visit.
