Licensing Program Analyst (LPA) Tiffany Holmes conducted an unannounced visit to close out the complaint investigation on the above listed allegations. LPA introduced herself, was granted entry, and met with Nick Fierro, Administrator to whom she disclosed the reason for the visit.

LPA previously conducted interviews with residents, staff, and outside sources, made observations, and obtained and reviewed pertinent records. LPA conducted the initial visit on 09/05/2025 and conducted a tour of the facility. It was alleged that staff illegally evicted a resident in care. Interviews revealed that Client 1 (C1) was given several 30 day notices in the time span that they lived at the facility. Interviews with the administrator revealed they have never given C1 a 3 day eviction. LPA Holmes observations revealed two copies of 30 day notices from September 2024 and again in April 2025. Interviews revealed that C1 has been given several 30 day notices during the ocurse of their time living there and never left the facility until this time. Interviews revealed that C1's family member was notified in early August about the facility giving C1 another 30 day notice and they picked C1 up on the fourth of September and C1 did not return.

The Department has investigated the above-mentioned allegation and based on interviews, LPA observations, and records review, it was determined that the complaint allegation is Unsubstantiated. The allegation may have happened or is valid, but there is not a preponderance of the evidence to prove that the alleged violation occurred.

An exit interview was conducted with Nick Fierro and a copy of this report along with Licensee/Appeal Rights (LIC 9058 03/22) was provided at the conclusion of the visit.
