On February 11, 2025, Home Care Services Bureau (HCSB) Enforcement Analyst (EA) Adrian Mangina conducted a complaint inspection for the purpose of delivering findings for the complaint received 1/22/25. EA met with Araceli Gutierrez, Regional Director, to discuss the findings.

It was alleged that TheKey of California, LLC is providing services outside the scope of Home Care Services because it advertises referral to skilled nursing services on the Home Care Organization (HCO) website. EA interviewed staff who stated that TheKey is an umbrella corporation operating several businesses in California including HCOs and a Skilled Nursing Referral agency. In states where legal TheKey offers skilled nursing to its home care clients throughout the United States. Regional Director, Araceli Gutierrez provided documents showing that TheKey operates a "concierge" nursing referral service at 73700 Dinah Shore Drive, Suite 202, Palm Desert, CA 92211 as an entirely separate entity with separate tax filing and independent business

To prevent confusion among California consumers, Th Key has modified their website to reflect that skilled nursing is available only in listed states where it is allowed. Based on Interviews conducted and records review, the complaint alleging Home Care Organization is providing services outside the scope of Home Care Services is found to be unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

An exit interview was conducted. A copy of this report was provided to the Designee via email.
