On May 4, 2026, at 2:50 PM, Licensing Program Analyst (LPA) William Chancellor arrived unannounced at The Learning Experience (CCC) to deliver the investigative findings regarding the allegation referenced above. LPA met with Director (DIR) Susette Sepulveda. On April 17, 2026, LPA initiated the complaint investigation, conducted observations, took census, completed confidential interviews, and obtained documentation relevant to the investigation.

On April 16, 2026, the Department received a complaint alleging that staff were allowed to work without a criminal background clearance. Four out of four confidential interviews corroborated that Staff 4 (S4) did not have an approved fingerprint clearance prior to working a total of six (6) days in the presence of day care children. A review of records further revealed that fingerprint applications for Staff 5 (S5), Staff 6 (S6), and Staff 7 (S7) had been initiated but official clearance letters had not been granted prior to their employment. As of April 25, 2026, the Care Provider Management Bureau (CPMB) verified that S5, S6, and S7 had initiated fingerprint applications prior to employment and have since been officially associated and granted clearance.

Based on interviews and record review, the preponderance of evidence standard has been met, and the allegation is substantiated. A violation of California Code of Regulations, Health and Safety Code section 1596.871(c)(1)(A), Administration of Child Day Care Licensing, is cited on the attached LIC 9099D. A civil penalty is assessed for S4 working a total of five days without clearance, totaling $500.

LPA William Chancellor informed Director Susette Sepulveda that this report dated May 4, 2026, documents one (1) Type A citation, which must be posted for 30 consecutive days due to the immediate risk to the health, safety, or personal rights of children in care.

LPA also informed Director Sepulveda that copies of this licensing report dated May 4, 2026, documenting the Type A citation, must be provided to all currently enrolled parents/guardians by the next business day or the next day children are in care, and to all newly enrolled parents/guardians for the next 12 months. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in each child’s file for verification.

An exit interview was conducted with Director Susette Sepulveda. LPA provided a copy of this report, appeal rights, and a Notice of Site Visit (NOS). The Director acknowledged that the NOS must remain posted in a prominent location visible to families and caregivers for 30 consecutive days.

Based on interview and record review, four employees prior to employment or initial presence in the CCC were not properly associated or granted fingerprint clearances. Where S4 worked six (6) days and was not cleared. S5, S6 and S7, fingerprint applications were initiated but not cleared prior to presence in CCC. Which poses an immediate health, safety or personal rights risk to persons in care.
