On October 3, 2022 at 12:18 p.m. Licensing Program Analyst (LPA) Leilani Curtis conducted an unannounced case management inspection in reference to the licensee’s request to have the facility’s newly constructed playground inspected and approved. Upon arrival LPA met with Director Karyne Begin and proceeded to tour the facility. There were 43 children with 7 staff members present. Appropriate capacity and ratio were observed. Staff member Perla Lopez Zurita was providing care and supervision to children in classroom #7. Miss Lopez Zurita does not have a criminal record clearance and is not associated to the facility. At the time of inspection Miss Lopez Zurita's criminal record clearance was in process. Director Begin states that today was Miss Lopez Zurita's first day in the facility and she has not associated her to the facility. At the time of inspection the director uploaded missing and required documents for Miss Lopez Zurita into the Care Provider Management Bureau's(CPMB's) Guardian background data system and associated her to the facility.

LPA measured and inspected the preschool and toddler playgrounds. The playground is located in the shopping center parking lot across from the facility. The director states that she will ensure that the children safely walk across the parking lot by having the children hold onto a cord/rope as they cross. The director has also added speed bumps to the parking lot. The preschool playground measures a total of 978.40 square feet, which is sufficient space for 13 preschool children. The toddler playground measures a total of 931.11 square feet, which is sufficient space for 12 toddler children. The playgrounds are completely surrounded by a fence that is over five feet tall. There is a smaller fence separating the toddler playground from the preschool playground. Both playgrounds include age-appropriate play equipment. The director states that additional equipment such as a covered sandbox and tricycles will be brought out to the playground for the children to use. Each playground has a canopy for shade. The director states that an additional canopy will be added to each playground for additional shade. Drinking water is readily accessible. The director states that the children's water bottles will be filled in the facility and taken out to the playground. They will also take water jugs out the the playground to refill the children's water bottles. The director provided LPA with a copy of the permit from the City of San Marcos allowing the facility to continue to use the Richmar Park for outdoor activities thru 10/31/22.

The director provided a playground waiver to LPA requesting to allow up to 13 preschoolers and 12 toddlers to use their specific playgrounds on a scheduled basis. Once the playground waiver has been reviewed and approved the new playground may be used.

See LIC809D for cited deficiency. A civil penalty has been assessed.

Per Chapter 3, Division 12, Title 22 of the California Code of Regulations, upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - AB 633 Child Care Parent Notification Requirements and a copy of LIC 9224 was given to the director

An exit interview was conducted with the director and appeal rights (LIC 9058 ) were discussed. A copy of this report as well as a copy of the appeal rights were given to the director at the conclusion of the inspection. The director’s signature on this form acknowledges receipt of these rights. LIC 9213 NOTICE OF SITE VISIT FORM IS REQUIRED TO BE POSTED FOR 30 DAYS. LPA observed the director post notice of site visit.

The director uploaded the required documents for Perla Lopez Zurita and associated her to the facility in the Guardian background data system at the time of inspection. Miss Lopez Perla left the facility. The director understands that Miss Lopez Perla is not to work in the facility until her criminal record clearance has been obtained.

Based on record review and observation, staff member Perla Lopez Zurita does not have a criminal record clearance and was not associated to the facility on 10/3/22, at the time of inspection. This poses an immediate health and safety risk to the children in care.
