On 8/3/26 at 8:15 am, Licensing Program Analyst (LPA) Annette Sutherland conducted an unannounced annual inspection and met with Licensee Su-Chen Hsiao. Facility helper Mikayla Lopez arrived shortly thereafter. The two-story home was toured and inspected to ensure that the environment was safe for the care and supervision of children. Eight day-care children were present during the inspection.

The licensee has provided adequate space for the children to eat, sleep, and play within the home. Areas used for childcare include the family room, dining room, living room, bathroom #1, bedroom #1—which is used for napping—and the backyard. Off-limits areas include the entire upstairs, kitchen, and garage. These areas are made inaccessible through the use of safety gates and doorknob covers. The stairs are barricaded.

The licensee has sufficient toys and equipment available. The home has a fenced backyard available for outdoor activities. The licensee also takes the children to a nearby park for outdoor activities and understands that supervision is required at all times during outdoor activities.

The fire extinguisher, smoke detector, and carbon monoxide detector meet requirements and are operational. All hazardous items were latched or locked and secured out of the reach of children. There are no bodies of water on the property. The licensee stated that there are no weapons in the home.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

The licensee’s Pediatric First Aid and CPR certifications expire on 1/12/27. The licensee has the required immunizations. The licensee completed Mandated Reporter Training, which expires on 3/20/28. The licensee was reminded that the training must be renewed every two years.

Children’s and staff records were reviewed and found to be in order. LPA obtained an updated facility roster and observed that all required documents were posted in an area accessible to parents and guardians. The provider was reminded to report suspected child abuse and neglect, maintain children’s records in accordance with regulations, post all required forms, properly control equipment, and refrain from smoking on the premises. Exersaucers, bouncy seats, walkers, and jumpers are not permitted in the day-care home. All equipment must be used according to the manufacturer’s instructions. LPA and the licensee discussed California Megan’s Law, and LPA provided the following website: www.meganslaw.ca.gov.

LPA reviewed LIC 311D, Forms/Records to Keep in Your Family Child Care Home, with the licensee, including children’s forms and records, facility forms and records, and information required to be posted. A review of staff records conducted on this date indicates that all facility staff members and other individuals requiring caregiver background checks have obtained criminal record and child abuse index clearances or exemptions. The licensee was reminded that all adults 18 years of age or older who reside or work in the home, including employees and volunteers, must obtain a criminal record clearance or exemption or transfer an existing clearance or exemption before their initial presence in the licensed family child care home. A civil penalty of $100 per day, up to a maximum of $500 per day, per person, may be assessed if this regulation is violated. LPA also informed the licensee of the importance of checking the United States Consumer Product Safety Commission website at https://www.cpsc.gov for recalled infant devices and recommended registering all infant devices with the CPSC to receive notifications regarding recalls of purchased equipment.

LPA verified that the licensee is conducting and documenting the required 15-minute infant sleep checks and has completed and signed the Infant Sleeping Plan (LIC 9227) for each applicable child’s file.

LPA provided the licensee with the Child Care Advocate Program email address: childcareadvocatesprogram@dss.ca.gov. For general questions or questions regarding licensing requirements, the licensee may contact the Child Care Licensing Duty Line at (619) 767-2248.

Incidental Medical Services (IMS) policies were discussed. For additional IMS information, refer to the Evaluator Manual, Regulation Interpretations and Procedures for Family Child Care Homes, Section 102417. When IMS are provided, a Plan for Providing IMS must be submitted to the Department. Information regarding the Americans with Disabilities Act was also provided, including the U.S.U.S. Department of Justice ADA Information Line at (800) 514-0301 (voice) or (800) 514-0383 (TTY), and the publication “Commonly Asked Questions About Child Care Centers and the ADA,” available at https://www.ada.gov/resources/child-care-centers/.

No deficiencies were cited.

An exit interview was conducted, and the report was reviewed with Licensee Su-Chen Hsiao. During the exit interview, the licensee confirmed that no registered sex offenders reside in the facility. LPA completed the Registered Sex Offender profile in FAS. A Notice of Site Visit was provided and must remain posted for 30 consecutive days.
