On 1/5/24 at 12:40 PM, Licensing Program Analyst (LPA) Keturah Lane, conducted an announced Pre-Licensing inspection for the applicant. Upon arrival, LPA met with applicant Bianca McKinney and also present was assistant Christopher Jasper and Licensee’s minor children. Applicant is applying for a large license and meets qualifications (has transcripts of ECE units and is fully qualified teacher) as well as experience requirements (12 years teacher at a childcare center) to open a large family daycare license. Applicant’s husband Orlonzo Smith arrived at approximately 2:30 PM. The one-story home was toured and inspected to ensure an environment safe for the care and supervision of children. The fire extinguisher, carbon monoxide detector, and smoke detector meet requirements and are operational. All hazardous items were latched/locked and secured out of reach of children. The home appears to be large enough to comfortably accommodate 14 children. Fire clearance was received on 1/30/23.

Applicant will be using the following rooms for childcare: office area, daycare room #1, daycare room #2 and daycare bathroom. Off-limits areas include: kitchen, living room, bathroom #2, bedroom #1, bedroom #2 and bedroom #3 which includes a smaller bathroom (#3) and are inaccessible through the use of a safety gates and door locks. The detached garage will also be off limits and is kept inaccessible through the use of a door lock. Applicant has a fully fenced outside play area located on the side of the house that is available for outdoor activities. The backyard is off-limits and is inaccessible to the side play area by use of a locked six-foot tall gate. The off-limits backyard has an empty pool that is not in use.

LPA observed that the empty pool in the off-limits backyard was completely surrounded by a four-foot mesh fence and privacy fence on the backside of the pool. The mesh fencing is connected to the privacy fence. LPA did not observe a gate that swings away from the pool that self-closed/latched. The applicant stated they remove a pole and section of the fence to enter the pool area. Applicant stated that they are not using the pool because it has a leak and do not plan to use the pool. LPA observed that the mesh fencing bends somewhat upon impact but also observed that it did withstand the weight of a large dog. The applicant’s dog will remain outside in the off-limits backyard during daycare hours. There are two windows and a backdoor in the off-limits living room that lead to the backyard with the empty pool. Applicant will install a door alarm and screw locks on both windows in the living room. The daycare children do not have access to the living room because of a safety gate installed by the kitchen. Two of the off-limit bedrooms (bedroom #1 and bedroom #2) also have windows that lead to the backyard that has the empty pool. Daycare children do not have access to the bedrooms because of the same safety gate by the kitchen. Applicant stated she will install screw locks on both bedroom windows that have access to the backyard. The daycare children will play in the side yard that also does not have access to the backyard. It is inaccessible by a six-foot locked rod-iron gate. A waiver of pool regulations will be requested by the applicant since it is not in use and made off-limits to daycare children.

The fireplace is screened and in the off-limits living room. There is a working phone at the facility. Applicant states that there are no weapons in the home. Applicant states that they have sufficient financial resources to sustain the license. CPR and First Aid expire on 10/8/24. Preventative health practices course was completed on 9/25/22 which includes lead poison prevention training. Mandated reporter training was completed on 5/20/23 and expires on 5/20/25. Assistant Christopher Jasper CPR/First Aid expires 12/17/25 and mandated reporter expires 1/4/26. Staff immunization requirements were met. Required documents have been posted. The applicant has toys and equipment available.

The new provider packet was reviewed with the applicant including information on child abuse and unusual incident reporting. LPA provided information regarding the YMCA Resource center. Applicant was reminded that corporal punishment, smoking, walkers, exersaucers, jumpers and bouncy seats are not allowed in day care. All equipment that is used should be used only as intended by the manufacturer. (continued on LIC809-C...)

The applicant provided proof of control of property. Because the applicant rents/leases the home, proof of landlord notification is required. The LPA observed the Property Owner/Landlord Notification form (LIC9151) that the applicant confirms was provided to the property owner/landlord. The applicant obtained a signed Property Owner/Landlord Consent form (LIC 9149). LPA reviewed with applicant the LIC 311D, Forms/Records to Keep In Your Family Child Care Homes, children’s forms/records, facility forms/records, and information to be posted. Entrance Checklist was provided to the applicant.

LPA discussed the safe sleep regulations with applicant and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep, as an additional resource. LPA also informed applicant of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

On this date, 1/5/2024, the California Attorney General - Megan’s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

Applicant was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated. Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. To receive important licensed related information to licensed facilities, visit the CCLD Important Information website at https://www.cdss.ca.gov/inforesources/community-carelicensing/subscribe and select the Child Care option to receive email communication.

The following corrections are needed prior to the issuance of the license:
1. Install screw locks on windows in living room and both bedrooms facing the backyard to prevent them from opening more than 4 inches
2. Install door alarm on living room door leading to backyard that can be heard throughout the home.
3. Request a waiver of Title 22 bodies of water regulations and receive approval

Once all corrections are made and proof is sent to licensing a license for 14 children may be granted. Applicant understands that proof of corrections must be submitted to Licensing within 30 days or the application may be denied. Applicant agreed to comply with all regulations and laws governing family child-care homes. Exit interview conducted and report was reviewed with the applicant Bianca McKinney.
