On 7/28/23 at 8:15am, Licensing Program Analyst (LPA) Patrick Ma conducted an announced Change of Location Pre-Licensing inspection with the applicant Fabine Vilsaint. Also present in the home were Applicant’s sister-in-law Waslande Tategrein, and 2 own children and 1 minor family member. Applicant stated, Ms. Tatergrein was only visiting for 2 more weeks. The 3 bedroom, 2 bathroom, 2 story apartment was toured and inspected to ensure an environment safe for the care and supervision of children.

Applicant will be using the living room, kitchen, downstairs bathroom, and backyard for child care. Off limit area is entire 2nd floor and needs to be made inaccessible at bottom of stairs. The applicant has sufficient toys and equipment available. Applicant will use fully fenced backyard for outdoor activities. Applicant was advised to provide visual supervision at all times when children are outdoors.

The fire extinguisher, carbon monoxide detector, and smoke detector meet requirements and are operational. All hazardous items in the home were latched/locked and secured out of reach of children during inspection, but hazardous items outdoors needs to be made inaccessible. There are no bodies of water on the property. Applicant states that there are no weapons in the home. Applicant states that they have sufficient financial resources to sustain the license. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions. First Aid and CPR expire on 6/2025 and copy of preventative health practices course is required. Applicant completed Mandated Reporter Training and expires on 6/4/25. Staff immunization requirements per SB792 were met.

The applicant provided proof of control of property. Because the applicant rents/leases the home, proof of landlord notification is required. The LPA observed the Property Owner/Landlord Notification form (LIC9151) that the applicant confirms was provided to the property owner/landlord.

The applicant has not obtained a signed Property Owner/Landlord Consent form (LIC9149). Without this consent, the applicant understands that, once licensed, they can operate with a maximum capacity of 6 children. If property owner/landlord consent is obtained in the future, the applicant is advised that a new Application for a Family Child Care Home License (LIC 279) must be submitted with a change of capacity fee of $25, to increase the capacity and provide care to 8 children.

LPA reviewed with applicant the LIC 311D, Forms/Records to Keep In Your Family Child Care Homes, children’s forms/records, facility forms/records, and information to be posted. Entrance Checklist was provided to the applicant.

Provider is hereby reminded of the following: Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms; corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers are not allowed in day care. All equipment that is used should be used only as intended by the manufacturer. LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov.

On this date, 7/25/23, the California Attorney General - Megan’s Law website was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore,
they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

Applicant was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.
