On 3/26/26 at 10:30 AM Licensing Program Analyst (LPA) Annette Sutherland conducted an unannounced visit for the purpose of delivering findings for the complaint received on 2/19/26 regarding the above allegation. Licensee’s husband Muhibullah Nuristan, their 3 minor children, 1 house guest Shanim Safi & her minor son. Also present was License’s sister-in-law Bibi Zainbai was also present during today’s visit. LPA toured the facility & found the facility to be operating within ratio. It was alleged that the facility was operating over ratio. The LPA visited the facility on 2/25/26 & again today & found the facility operating within ratio. The LPA reviewed timesheets, which were completed & submitted by the licensee Azita Safi. She stated that she made an error on the timesheets & that the facility was not operating over capacity. Licensee provided a declaration stating that they did not operate over capacity & that the error was solely on the timesheet. The LPA was unable to interview parents, as phone calls were not returned. LPA was unable to find corroborating evidence to support the allegation that more than 8 children were present at one time. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, therefore the above allegation is found to be Unsubstantiated. Exit interview conducted & report was reviewed with the licensee. A notice of site visit was given & must remain posted for 30 days. |
