32 | This investigation revealed numerous incidents of domestic violence, including two documented by the Police Department; however, according to a PD report, many were incidents were unreported. Additional, factors include the arrest of Miguel and subsequent charge, the volatile and unpredictable home environment. These combined serious factors created an immediate risk to the health, safety, and personal rights of children in care. The licensee failed to provide a safe and healthy environment and failed to ensure Miguel obtained the required criminal record clearance and a Type A deficiency was cited on case management for failure to ensure adults in the home comply with fingerprint clearance requirement.
Based on the information obtained during the investigation, the allegation is substantiated.
Additionally, the licensee failed to report the adult residing in the home and reportable incidents involving law enforcement. Deficiency was cited on case management for failure to report.
Type A deficiency is cited on the accompanying LIC 9099D.
LPA Mohsini informed licensee Margarita Lopez-Silverio that this report dated (8/19/26) documents a Type A citation. Type A citation which shall be posted for 30 consecutive days as there are immediate risk to the health, safety, or personal rights of children in care. Also, LPA Mohsini informed the licensee Margarita Lopez-Silverio to provide a copy of this licensing report dated (8/19/26) that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
