On 8/16/23 at 9:55 AM, Licensing Program Analyst (LPA) Keturah Lane visited the facility to conduct an annual inspection. Upon arrival LPA met with Director Andrea D’Agostino and proceeded to tour the facility. Census was as follows:
Infant Room 1 had 8 infants (0-12 months) in care with staff members Maria Mora and Diana Vazquez.
Infant Room 2 had 12 infants in care (12-24 months) with staff members Jazzlyn Hagmoc-Garcia, Justine Colada and Brook Wilbur.

Appropriate ratios and capacity were observed. Rooms have adequate heating, lighting, ventilation. Cleaning supplies are kept separate from food and are inaccessible to children. Storage containers for solid waste have tight-fitting covers and are kept in good repair. Director stated there are no firearms or other weapons on the premises. All foods/beverages capable of rapid spoiling are stored in covered containers at 45 F or less. The facility appears to be free of insects and rodents. There is an operational carbon monoxide detector at the facility. Last emergency drill was conducted on 4/28/23.

All infant furniture & equipment are age appropriate and in good repair. Floors appear to be safe and clean. There are no walkers, bouncy seats, exersaucers or jumpers in the room. Feeding tables have broad-based legs, plastic seats in good repair and table (no locking trays). Hazardous materials are inaccessible to children. Bottles, dishes and containers of food brought by infant’s authorized representative are labeled with the infant’s name and current date. The changing table is within arm's reach of sink. There are currently no children being potty trained in either classroom. Caregivers wash hands before and after each feeding and each diaper change. (continued on LIC809-C...)

(A) Staff shall place infants up to 12-months of age on their backs for sleeping. (4) Infants with an Individual Infant Sleeping Plan [LIC 9227 (3/20)] that have Section C of the form completed and signed by an authorized representative shall be placed on their back when first laid down to sleep. In the event the infant changes position, the infant may remain in the alternative position. LPA observed infant C1 sleeping on her stomach and section D had not been updated that infant could roll over both ways. LPA observed staff member return C1 to her back and obtained updated LIC9227 form from Director at inspection. Deficiency was corrected at inspection.

Toys are safe, with no sharp edges, splinters or protruding points, nor small parts that can be pulled off and swallowed. Floor mats and cots are available for infants able to climb out of cribs. Cribs or napping equipment are available. Bedding is identified and stored separately for each infant. Napping infants are under visual observation by staff. Indoor activity space is physically separate from other components.

LPA observed that C2 did not have an Infant Needs and Services Plan or an Individual infant sleep plan on file and has been in attendance at the center for one week. At 10:43 AM, LPA also observed child C1 sleeping on her stomach. C1 did not have the section updated on LIC9227 Individual Infant Sleep plan stating that she can roll over from back to stomach and stomach to back. C1 was returned to her back and LPA advised Director and an updated form was provided to LPA during the inspection. LPA observed during record review that some infants had the LIC9227 form and others had a similar facility form but did not address all questions on the LIC9227. LPA advised Director to have all parents fill out the LIC9227 form for each child 0-12 months of age and file. LPA also observed several sleep sacks in cribs and asked Director if they have a waiver to use the sleep sacks. Director was unaware that a waiver was needed. LPA stated she would provide technical assistance regarding the waiver via e-mail.

Outdoor play area is a fenced playground with sufficient material for cushioning. There are no bodies of water at this facility. Climbing structures, swings and slides are securely fixed to the ground. Area has overhang from building used for shade. Equipment is age appropriate. Area has drinking water readily accessible, and grounds are free of debris or potential hazards. LPA observed that equipment outside in play area needs to be cleaned more thoroughly and observed visible dirt on multiple toys. Staff stated they sanitize and wipe them down every day.

There is no medication for any infants in use at this time at the facility. Personnel records contain health screening documentation and at least one staff member has current CPR and First Aid certifications. All staff have completed mandated reporter training and required immunizations. (continued on LIC809-C...)

Infant care teachers meet educational requirements. Sign ins were reviewed. Children’s records contain admission agreements and medical assessment. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment. Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

This facility provides Incidental Medical Services – IMS (for preschool license only). LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records.
