On 6/27/24 at 1:39 pm, Licensing Program Analyst Gerald Poindexter made an unannounced visit for the complaint received on 4/4/24 for the purpose of delivering findings on the above reference allegation. LPA met with Lizzie Becker, supervisor. The following ratios were observed today: 48 children from three classrooms, supervised by 7 staff members (four teachers, three aides). Facility is with ratio.

Based on the information gather from the investigation -- during observation at the facility, review of facility records, and other pertinent documentation, and interviews with the Reporting Party (RP), facility staff, other persons, and parents -- allegations are verifiable as follows:

The allegation that “Classroom is operating out of ratio” is valid. Per investigation interviews and witness documentation, teacher-child ratios were exceeded due to the presence of unqualified aides without ECE credentials. Additionally, multiple occasions were cited by witnesses, who described staff late to arrive when teachers or aides requested assistance to remain in ratio. Additionally, it was determined that teacher-child ratio was not maintained during all outside playground times.

The allegation that “Unqualified staff providing care and supervision to daycare children” is valid. Per investigation interviews, facility documentation, and direct witness, multiple occasions were cited when unqualified aides were left alone either individually or with other unqualified aides to supervise classrooms with active, non-napping children.

The allegation that “Daycare child was left outside unattended” is valid. Per investigation interviews and witness documentation, staff left a child behind in the playground without staff present to provide care and continuous visual supervision.

The allegation that “Staff are not properly supervising children” is valid. Per information gathered during investigation interviews, staff were observed outside at the playground using cell phones for personal use, while not maintaining continuous visual supervision of children in care.

The above allegations are found to be SUBSTANTIATED. The allegations are valid because the preponderance of evidence has been met. See LIC9099D for Type A and B deficiencies cited and civil penalty.

Exit interview conducted and report was reviewed with Lizzie Becker. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal rights were provided.

Based on interviews and witness documentation, it is determined that in March 2024 a staff member left a child outside in the facility playground, unattended, and without care, supervision and required visual observation, for a period of approximately 2 to 5 minutes, which is an immediate health, safety and personal rights risk to children in care .

Based on information gathered during investigation interviews it is determined that staff did not maintain care and supervision outdoors, as witnesses observed staff -- during children’s afternoon activity on the playground -- using cell phones for personal use. This poses a potential risk to the health and safety of children in care.
