On 08/15/2023 at 1:10PM, Licensing Program Analysts (LPAs) Selina Siao and Gerald Poindexter conducted an annual inspection. Upon arrival, LPAs met with Director Emma Duenas and proceeded to tour the facility. The following ratios were observed: Classroom #1 (Lily's) had 19 children napping on cots supervised by teacher aide Sereen Alhamwi. Classroom #2 (Tulips) had 12 children napping on cots supervised by teacher Anjanette Berry. Classroom #3 (Sunflowers) had 15 children napping on cots supervised by teacher Gloria Hernandez. Facility is within napping staffing ratio. All required notices, forms and license were posted. Furniture and age-appropriate equipment is in good condition. Rooms have adequate heating, lighting, ventilation and drinking water. Storage cubbies are readily available, and room accommodates class size. Napping equipment consists of cots which are kept in the classrooms and each cot has its own sheet or covering. Bathrooms are maintained with operational toilets and faucets with appropriate temperature. Paper towels and toilet paper are available. Bathroom is lighted and has ventilation. Food service area consists of a kitchen which is clean and free of hazards. Menu is posted. Adequate food is available for snacks and lunch is catered. Cleaning supplies are not accessible to children. Outdoor play area is a fenced playground with sufficient rubber cushioning. Climbing structures and slides are securely fixed to the ground. There are tarps used for shade. Equipment is age appropriate for children ages 2-5. The playground and all three classrooms have drinking water available for children. LPAs observed an electric saw on the ground located at the other side of the chainlink fence behind the playhouse that was accessible to children. Facility uses an electronic sign in and out system. LPAs reviewed first aid supplies and reviewed medication policy and storage; all areas are within compliance. Isolation area is the Director's desk area. Personnel and client records were reviewed, and staff members have the required measles and Tdap immunization and completed the online mandated reporter training. Reporting requirements was also reviewed. All personnel have required criminal record and child abuse index clearances or exemptions. LPA reviewed Emergency Disaster Plan and the last fire and earthquake drill was conducted on 5/17/2023. Facility has an operating carbon monoxide detector. Facility has at least one staff member that has a valid EMSA approved pediatric CPR/FA when children are in care.

Based on LPAs observations, the licensee did not comply with the section cited above, LPAs observed a powered handsaw on the ground, located on the other side of the chainlink fence next to the playhouse accessible to children, which poses/posed a potential health, safety or personal rights risk to persons in care.

Director removed the powered handsaw from the ground during the inspection. Director will talk to the maintenance and other staff members to ensure that hazards are not accessible to children. Director will submit the training agenda topic with staff members names and signature to LPA no later than 08/21/2023.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of “medication and equipment/supplies, and reviewed children’s, personnel, and administrative records.

Child Care Providers can now sign up for Quarterly Updates and PINS through the DSS website at https://cdss.ca.gov/inforesources/community-care-licensing/subscribe. LPA discussed California Megan's Law with provider and advised her to go on the website at www.meganslaw.ca.gov.

Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

For childcare center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP).

LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.
