32 | For the first incident on 10/10/24, the LPA determined that two staff were present supervising all students, but did not directly observe the specific child injuring another child’s finger with a toy car. Staff assessed the injured child at the time, who they noted did not show signs of distress or injury. Minutes later, the staff reported the incident directly to the child’s parent, in-person, who picked up the child. The injury was medically diagnosed the next day. Based on interviews with staff and the RP, LPA determined that the incident was accidental from acts of play between children. Video from that classroom was no longer available for review.
For the second incident on 2/19/25, LPA reviewed outdoor playground camera footage in which the child sustained an injury. LPA observed approximately 7 children – including the injured child – who spontaneously surrounded and hugged the legs of a teacher. Subsequently, the teacher lost balance and accidently fell onto the child, injuring the child’s leg. The other staff present was supervising in another playground area. Staff stated that they immediately attended to the injured child and called parents.
Several staff interviewed by the LPA stated that the facility has adopted changes to the playground spacing and observation, and that additional playground staff has been in place since January 2025. Parents interviewed did not express concerns similar to the allegations.
Based on the information obtained during a tour of the facility, interviews, and documentation and video reviewed, the above allegations cannot be proven or disproven. Therefore, they are considered UNSUBSTANTIATED. A finding that the complaint is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.
No deficiencies are cited.
Exit interview conducted and report was reviewed with Maggie Gonzalez, center director. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal rights were provided. |
