On 9/4/25 at 10:00 am, Licensing Program Analyst (LPA) Gerald Poindexter made an unannounced visit for the complaint received on 8/4/25 for the purpose of delivering findings on the above reference allegation. LPA met with Erica Castaneda, center director. There were 82 children present in 7 classrooms with 18 staff. Facility is with ratio.

It was alleged by the Reporting Party (RP) that “Facility did not notify parents of a type A violation” as it relates to a licensing report and Type A deficiency that the facility received on 6/17/25. During the course of the investigation, LPA Poindexter visited the facility, reviewed facility documents, and interviewed the RP and facility staff.

Licensing Department records show that the facility received an LIC9099 licensing report and LIC9099D deficiency page, which identified a Type A citation. The LIC9099 licensing reported stated: “Also, LPA Annette Sutherland informed the Site Director Erica Castaneda to provide a copy of this licensing report

dated 6/17/25 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.” The report further states that LPA Sutherland reviewed the report with Ms. Castaneda. The report was then acknowledged and signed by Ms Castaneda.

Based on the LPA’s interview with Ms. Castaneda on 8/12/25, the required distribution of the LIC9099 licensing report and LIC9224 form to parents of children in care, had not occurred. Additionally, the LPA’s review of the facility children’s files did not yield signed copies of the LIC9224 form.

Based on the information obtained during interviews and documentation reviewed, it is determined that the allegation is valid because the preponderance of the evidence has been met, therefore, the allegation is found to be SUBSTANTIATED.

Exit interview conducted and the report was reviewed with Erica Castaneda, center director. A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal rights were provided.
