On 08/09/2023 at 2:06pm, Licensing Program Analyst (LPA) Jennifer Lott conducted a complaint investigation visit to deliver findings for the complaint received on 07/03/2023. LPA was greeted at the front of the facility by Director, Linda Mendez and was granted entry after identifying herself and disclosing the reason for her visit.

The Department’s investigation consisted of a review of records and interviews. It is alleged that on or about 06/24/2023 that staff yelled at day care children and that a day care child sustained an unexplained injury while in care. Based on the information obtained during interviews, observations and documentation reviewed, it is determined that staff do not yell at the day care children. Although one staff has a loud voice, interviews revealed that they still do not yell at the children. Interviews also revealed that it is unknown how C1 got a bruise on their arm. Interviews revealed that staff do not pick up children by the arms, but rather lead them by the hand. There is no evidence to prove that the injury the child sustained occurred at the facility.

This agency has investigated the complaint alleging staff yell at day care children and day care child sustained unexplained injury while in care. The Department has found that although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations occurred, therefore the above allegations are found to be UNSUBSTANTIATED. Exit interview conducted and report was reviewed with Director Mendez. A notice of site visit was given and must remain posted for 30 days.
