On 9/13/23 at 12:45 PM, Licensing Program Analyst (LPA) Keturah Lane conducted an unannounced initial 10-day visit for the complaint received on 9/8/23 regarding the above allegations. Upon arrival, LPA met with Director Dolores “Liz” Guadarrama and toured the facility. Census today was as follows during naptime:
• Classroom #1 had 12 children with staff member Amber Smith
• Classroom #2 had 9 children with staff member Victoria Hoey
• Classroom #3 had 16 children with staff members: Vanessa Marrujo & Christina Martinez
• Classroom #4 was not in use
LPA observed appropriate ratios and capacity during inspection. During this visit LPA conducted interviews with two staff members and Director, observed video footage and obtained requested documents. (continued on LIC9099-C...)

THIS IS AN AMENDED REPORT: Based upon information obtained during review of video footage, documents received from the facility and interviews with the reporting party, other parties and staff members, it is determined that a staff member did inappropriately handle a daycare child in an aggressive manner and the parents of the child were not notified of the incident either verbally or in a written format from the facility. Therefore, the allegations have been found to be SUBSTANTIATED. (See LIC9099-D for citations)

LPA Keturah Lane informed facility representative Director Dolores “Liz” Guadarrama that this report dated 9/13/23 documents 1 Type A citation (and 1 Type B citation) which shall be posted for 30 consecutive days as there was an immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Keturah Lane informed the facility representative to provide a copy of this licensing report dated 9/13/23 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.


Exit interview conducted and report was reviewed with facility representative Director Dolores “Liz” Guadarrama.

Notice of Site Visit was provided and must be posted for 30 days.

Staff member was terminated upon review of the video footage of the incident. Facility reported the incident to Licensing following reporting requirements 101212(d)(1)(C). In addition, Director stated she will have a staff training to review personal rights 101223 and have staff watch the video “Children’s Personal Rights in Child Care” video on the Department website:

Director & management spoke with the parents on 9/5/23 & 9/6/23 and they were shown the camera footage. Director stated she would provide a written incident report provided to the parents and e-mail to LPA Lane by 9/22/23. In addition, Director stated she will review Reporting Requirements Title 22: Section 101212 and e-mail a written statement to Licensing that she understands and will follow the reporting requirements.

Based upon parent and Director interviews, a written incident report was not provided to parents, nor were parents advised of the incident verbally by facility which is a potential health, safety and personal rights risk to children in care.

LPA advises that Director review the Child Care Reporting Requirements video on the Department website: ccld.childcarevideos.org/child-care-center-operators/ for additional information.
Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.
