On 11/8/24 at 9:10 AM, Licensing Program Analyst (LPA) Keturah Lane visited the facility to conduct an annual inspection. Upon arrival LPA met with Assistant Director Shaun Bergmark and Director Dolores Guadarrama and proceeded to tour the facility. LPA observed a total of 31 infants/toddlers in the following classrooms during today’s inspection:

· Room 6 had 7 infants (0-12 months) with staff members Emily Wolford and Marilyn Mendoza
· Room 7 had 8 infants (12-24 months) with staff members Brynna Kokosenski-Merezko and Laticia Salgado and Vanessa Marrugo
· Room 5 had 11 toddlers (18-36 months) with staff members Mary Kun and Jasmine Vannavong
· Room 8 had 5 toddlers (18-36 months) with staff members Katherine Supan and Jackson Cantrell

Appropriate ratios and capacity were observed. LPA observed appropriate care & visual supervision during the inspection. Between 10:10 - 10:30 AM, LPA observed two infants sleeping on mats on the floor and were wearing sleepsacks. LPA advised Director that an exception is needed to continue use of sleepsacks as the Department considers them to be a form of swaddling which is not allowed under Title 22 regulations. (see LIC9102TA). Also, infants may only sleep on mats/cots on the floor if they are able to climb out of a crib.

All infant furniture & equipment are age appropriate and in good repair. Rooms have adequate heating, lighting, ventilation. Floors appear to be clean and safe. Drinking water is readily accessible. There are no walkers, bouncy seats, exersaucers or jumpers in the room. Feeding tables have broad-based legs, plastic seats in good repair, and tray locked. Hazardous materials are inaccessible to children. Bottles, dishes and containers of food brought by infant’s authorized representative are labeled with the infant’s name and current date. The changing table is within arm's reach of sink. LPA observed sides of changing tables to be less than the required 3 inches to keep a child from rolling off the table. There is no potty-training in the infant license, currently. Caregivers wash hands before and after each feeding and each diaper change. Toys are safe, with no sharp edges, splinters or protruding points, nor small parts that can be pulled off and swallowed. (continued on LIC809-C...)

LPA observed there was not enough cribs (or portable cribs) available for the infants that cannot climb out of them. Once infants can climb out of the cribs, there are cots/mats available for them. Currently the facility is allowing parents to choose whether they prefer cribs or mats for the infants. According to California Title 22 Regulations, infants must sleep in a crib or portable crib until they are able to climb out of them. Bedding is identified and stored separately for each infant. Napping infants are under visual observation by staff. Indoor activity space is physically separate from other components. Facility maintains individual feeding plans for each infant and has up to date Infant Needs and Services Plans for each infant on file. Sleep logs were reviewed and found to be completed, however an updated form is needed. LPA provided technical assistance regarding required information to be documented during sleep checks (see LIC9102TV).

Food service area consists of a kitchen which is clean and free of hazards. Menu is posted. Adequate food is available for meals. Cleaning supplies are kept separate from food and are inaccessible to children. Storage containers for solid waste have tight-fitting covers and are kept in good repair. Director stated there are no firearms or other weapons on the premises. All foods/beverages capable of rapid spoiling are stored in covered containers at 45 F or less. The facility appears to be free of insects and rodents. There is an operational carbon monoxide detector at the facility. Last emergency drill was conducted on 10/28/24.

Outdoor play area is a fenced playground with sufficient material for cushioning. There are no bodies of water at this facility. Climbing structures, swings and slides are securely fixed to the ground. Area has trees and canopies used for shade. Equipment is age appropriate. Area has drinking water readily accessible, and grounds are free of debris or potential hazards.

LPA reviewed medication storage. Personnel records contain health screening documentation and at least one staff member has current CPR and First Aid certifications. All staff have completed mandated reporter training and required immunizations. Infant care teachers meet educational requirements. Sign ins were reviewed. Children’s records contain admission agreements, medical assessment and were found to be complete. LPA observed the LIC9227 Individual Infant Sleeping plan was not being completed correctly regarding sections C & D when infants are observed to be rolling over. LPA provided technical assistance on how to fill out the forms properly. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions. Toddler program is kept separate from infant program at all times.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.



LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed facility representative of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California. (continued on LIC809-C...)
