On 11/6/23 at 1:30 PM, Licensing Program Analyst (LPA) Keturah Lane conducted an unannounced case management visit to follow up on an unusual incident report that occurred on 10/25/23. Upon arrival, LPA Lane met with Director Dolores (Liz) Guadarrama and toured the facility during naptime. Naptime census was as follows:
Room #8 had 9 children with staff members Savannah Isenman and Bryana Gilbert
Room #7 had 9 children with staff member Leticia Salgado
Room #6 had 7 children with staff members Nancy Alvernaz, Mayte Guzman and Kelsey Banning
Room #5 had 3 children with staff member Alexsandra Arballo

On 10/25/23, a child was injured while leaning over a small railing in the playground area. The stage area in the playground has two steps. The child fell over the railing sustaining a bruise to the nose and scratch above the lip when child hit the concrete below. The child had no other injuries but was taken to urgent care as a precaution. There have been no previous injuries involving the small railing, however Director stated they plan to fence off the area, so that the railing will no longer be needed. LPA observed that the railing was very low to the ground and not high enough for taller children. Until the area has been renovated with a new fence, the staff will supervise and help the children down the stairs in the area or redirect to another area. Parents were called immediately and provided a written incident report. The incident was reported to licensing on 10/26/23 via the duty line and provided the written report on 11/2/23.

Director stated that the railing will be replaced with a 4 foot fence by 12/6/23. Until then, Director stated that staff will supervise the area and help children down the stair area or redirect to another activity.

Based upon LPA observation, the stair railing in the upper playground area was not tall enough for all children that use it which is a potential health, safety and personal rights risk to children in care.
