25 | On 01/11/23 at 8:50am, Licensing Program Analyst (LPA) Samantha Clenista conducted an unannounced case management site inspection to follow up on two self-reported incidents that occurred on 10/29/22 and 11/29/22. LPA met with Director, Christine D'Amico, and proceeded to tour the facility. There were a total of 10 children with a total of 3 staff members. Children in care were observed playing indoors. Appropriate ratio, capacity and supervision was observed during inspection. On 10/29/22, facility reported that Child #1 sustained a nursemaid elbow by another child pulling on his arm trying to get up the slide while Child #1 was trying to go down the slide. On 11/29/22, facility reported that Child #2 sustained a fractured arm from trying to climb up the ladder attached to playground structure, however fell off and onto his arm.
During inspection LPA assessed where both the incidents occurred and how it occurred by interviewing the staff who directly witnessed both incidents and the children who sustained the injuries. LPA observed the area to be safe, age appropriate and free of hazards. The incidents occurred on the playground play structure, which is age appropriate for 2-5 years old. LPA also observed sufficient cushioning (rubber wood chips) under all areas where a child can sustain a fall. Ms. D'Amico provided LPA with related documentation such as medical reports and incident reports prior to the inspection which LPA reviewed. Based on information gathered and LPA's observation of the area where the incidents occurred, LPA confirmed that no violations have been identified and that both injuries that Child #1 and Child #2 sustained were an accident. Ms. D'Amico explained that the facility has increased their playground "safety talks" to the children regarding playground procedures and added that if anyone does not listen to the safety procedures (i.e. no climbing up the slide), all the children will have to go back inside. Ms. D'Amico stated that ever since implementing this increase reminder, there have been no additional accidents and the children have done better at listening.
LPA reviewed this report with Ms. D'Amico at conclusion of visit. LPA provided a copy of LIC 9213, “Notice of Site Visit,” and observed Ms. D'Amico post the notice during visit. Notice must remain posted for 30 days. |
