On 12/3/24 at 1:00 PM, Licensing Program Manager (LPM) Tashima Daniel and Licensing Program Analyst (LPA) Keturah Lane conducted an announced office meeting with Nicole Hall and husband Tom Hall, owner of Taproot Montessori to discuss regulations regarding inspection authority, child/teacher ratios and staff qualifications. The office meeting was held at San Diego North Regional Office located at 7575 Metropolitan Drive, Suite 110 in San Diego, CA 92108.

Inspection Authority of the Department (Title 22, Division 12, 101200 (b)(1) was discussed with Ms. Hall regarding allowing private interviews for children and staff. "101200 (b) The Department has the authority to interview children or staff without prior consent. (1) The licensee shall ensure that provisions are made for private interviews with any children or staff.

At the last facility visit on 10/30/24, Ms. Hall was present during two staff interviews conducted by LPA Lane. During this office meeting, Ms. Hall clarified that both staff members requested her presence during said interviews conducted by LPA Lane. Regulations for Teacher-Child Ratio (101216.3) and Preschool Program with a Toddler Component (101216.4) were reviewed with Ms. Hall. There is to be no co-mingling between the preschool and toddler option. “The toddler program shall be conducted in areas physically separate from those used by older children (101216.4(2)”. “No child in the toddler program shall be placed in the preschool program before the age of 30 months without written permission from the child’s authorized representative (101216.4 (1)”. Owner Nicole Hall stated her intention to submit a waiver for commingling during the first and last hour of operation. Ratios for toddler and preschool components were discussed.

Regulations for Teacher Qualifications were reviewed with Ms. Hall. At the last facility visit on 10/30/24, LPA Lane discussed with Ms. Hall that teacher S1 was left alone with two children (one child was preschool age and the other child was a toddler) during an incident that happened on 10/22/24 at the facility. S1 was the only staff member on the premises during the time of the incident (5:15-5:30 PM) on 10/22/24. S1 is not a fully qualified teacher as she has not completed the required number of units to be left alone with daycare children. Pursuant to Title 22 of the CA Code of Regulations, the following Type B deficiency was cited and a correction was discussed (see LIC809-D). This is a repeat violation. Civil penalties were assessed in the amount of $250. There was a discussion above having qualified staff, following ratios and having a back-up plan when facility only has 2 remaining staff at end of shift.

The complaint process was also discussed with Ms. Hall as well as the findings of the most recent complaint (see separate report). Exit interview conducted and report was reviewed with Licensee/Owner Nicole Hall. A notice of site visit was provided and must be posted for 30 days.

Owner stated herself and Director Margarita Carmargo will cover until a new staff member has been hired. Owner stated that she understands that unqualified staff must be supervised by a fully qualified staff member. Deficiency was cleared at visit.

Based upon record review and interviews with S1 and Owner, S1 is not a fully qualified teacher and was left alone with two enrolled children which is a potential health, safety and personal rights risk to children in care.
