On 12/3/24 at 1:30 PM, Licensing Program Manager (LPM) Tashima Daniel and Licensing Program Analyst (LPA) Keturah Lane conducted an announced office meeting with Owners Nicole Hall and Tom Hall, for the purpose of delivering findings for the complaint received on 10/30/24 regarding the above allegation.

It was alleged that a staff member inappropriately restrained a day care child. During the course of the investigation, LPA Lane obtained facility/staff rosters, photos, sign-in & out sheets and other facility documents. LPA also interviewed reporting parties, daycare children, parents of daycare children, staff member S1, director Margarita Camargo and owner Nicole Hall. Based upon the information obtained during these interviews and documentation reviewed it is determined that child C1 was restrained in a transition chair with a safety belt for a few minutes while staff member S1 went to answer the front door with another child. The allegation is valid because the preponderance of evidence has been met, therefore the above allegation is found to be Substantiated. (See LIC9099-D for Type B deficiency cited). Exit interview conducted and report was reviewed with owner Nicole Hall. Notice of site visit was provided and must be posted for 30 days.

Owner stated they are no longer using the straps on the transitional chairs. Owner provided training to staff and will provide LPA with staff agenda and sign-in sheet via e-mail. Owner also stated they will walk the children up to the door upon pickup.

Based upon interviews with reporting party, staff member S1, director and owner, on 10/22/24 a child (C1) was restrained in a transitional chair with a safety belt while S1 went to answer the door which is a potential health, safety and personal rights risk to children in care.

It was alleged that staff do not ensure that drinking water is accessible to the daycare children. During the course of the investigation, LPA Lane obtained facility/staff rosters, photos, sign-in & out sheets and other facility documents. LPA also interviewed reporting parties, daycare children, parents of daycare children, staff member S1, director Margarita Camargo and owner Nicole Hall. Based upon LPA observation, interviews conducted and documentation reviewed that drinking water was accessible to the daycare children. LPA observed water bottles in a basket placed nearby the lunchboxes. Children interviewed stated they were able to drink water by raising their hand and asking to get their water bottle and were able to retrieve it on their own without assistance. Staff members stated that toddlers are provided their water bottles regularly and they are taken outside when children go outside. (continued on LIC809-C...)

Staff members also stated that the water bottles are filled back up when empty, so a child may go home with a full water bottle.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation occurred, therefore the above allegation is found to be Unsubstantiated. Exit interview conducted and report was reviewed with owner Nicole Hall. Notice of site visit was provided and must remain posted for 30 days.
