On 6/1/23 at 10:15 AM, Licensing Program Analyst (LPA) Keturah Lane conducted an unannounced Proof of Corrections (POC) visit at the facility. Upon arrival, LPA was met by staff member Aylin Zamora and toured the facility. At 10:16 AM, LPA observed 14 toddlers with staff members Aylin Zamora and Director Margarita "Maggie" Camargo in Pine room. Toddlers were transitioning to outside play. A few minutes later, LPA observed 32 preschoolers with staff members Guadalupe Ruiz and Jazmin Parra in the Palm room. LPA then went outside to the playground to speak to the Director. Director stated to LPA that staff member Areli Mendez Smith was also present in the facility. When LPA walked back into the Palm room a couple minutes later, staff member Areli Mendez Smith was present and stated she had been in the bathroom. With the current count of children and staff members present, it is not possible for a staff member to go to the bathroom without putting the classroom out of ratio. Title 22 regulations for ratios for toddlers are 1:6 and for preschool 1:12, therefore both classrooms are again out of ratio. At 10:45 AM, Owner Nicole Hall arrived at the facility. LPA spoke with the owner and reminded her of parents rights to enter the facility and recommended resources for communication with parents. (See LIC9102 TV and LIC9102 TA).

LPA Keturah Lane informed Licensee Nicole Hall that this report dated 6/1/23 documents 2 Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.

Director stated they will notify the parents and update admission agreements to move two toddlers to the preschool classroom classroom, effective tomorrow 6/2/23 which will leave 12 toddlers enrolled. There will be two qualified staff members for the toddler classroom.

Based upon LPA observation and sign in/out sheets, there were 32 preschool children with only two staff members (a third staff member was on site but in the bathroom) which is an immediate health, safety and personal rights risk to children in care.

In the preschool classroom there will be 3 teachers supervising no more than 36 preschool age children. Owner Nicole Hall will be at the facility to give breaks to teachers during operating hours. If anyone calls in sick, a teacher from the Jamul location will substitute. After 6/12/23 there will be two new teachers starting at the facility.

Also, LPA Keturah Lane informed the licensee to provide a copy of this licensing report dated 6/1/23 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

See LIC809-D for Type A deficiencies cited. Civil penalties were assessed in the amount of $1,800 for failure to correct the deficiencies. Facility representative was provided a copy of the Civil Penalties Assessment LIC421FC.
