13 | On 8/11/26 at 9:45 am, Licensing Program Analyst (LPA) Gerald Poindexter made an unannounced visit to deliver the findings for a complaint received on 5/28/26. The LPA met with Miriam Reyes, center director. There were 13 children present in two rooms; two staff with 6 infants and one staff with 7 preschoolers. Facility is within ratio and capacity. During the investigation, the LPA toured the facility, interviewed the anonymous Reporting Party (RP), staff members, and reviewed facility documents.
The RP alleged that “unqualified staff is providing care and supervision,” in refence to an aide being left alone to care for four infants. The LPA interviewed staff and reviewed staff time cards. The time cards indicated that on 5/27/26, staff S1, a teacher aide with only three educational units, was left without the required, continuous presence of a qualified teacher in the infant room for approximately 25 minutes from 11:42 am to 12:07 pm. 32 | During in the investigation, the LPA observed the portable sink stocked with water and to be operable. Staff interviewed, including the teacher responsible for maintaining the portable sink, denied that the tanks were empty. They stated that the tanks get filled enough for several days and suggested that someone unfamiliar with the sink might have to ask how to use it.
The RP alleged that “diaper changing area is not being properly maintained” – specifically, that it was not wiped after diaper changes. The LPA observed staff change diapers while at the facility. Staff interviewed outlined their process for diaper changes, and all invariably cited using a bleach solution to wipe the changing area. Parents interviewed did not express similar concerns with cleanliness or sanitization, as the RP.
The RP alleged that “staff did not change a daycare child's soiled diaper timely,” as related to a child leaving the facility unchanged. Staff interviewed denied knowledge of the incident alleged. The director, Ms,. Reyes, states that diaper changes happened every two hours, as needed, and she had not heard of the incident from a child’s parent. Parents interviewed expressed no concerns with diapering.
Based on interviews, the LPA determines that the above allegations cannot be proven or disproven. Therefore, they are considered UNSUBSTANTIATED. A finding that the allegation is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.
Exit interview conducted and report was reviewed with Miriam Reyes, center director. A Notice of Site Visit was given and must remain posted for 30 days. Appeal Rights provided. |
