32 | The facility currently has a fully fenced playground area. Fencing via wrought iron and chain link fences and it is at least four feet high. The infant outdoor activity space measured to be 405.32 square feet, which is only sufficient for 5 infants at one time. The toddler outdoor activity space measured to be 879.74 square feet, which is only sufficient for 11 toddlers at one time. And the preschool outdoor activity space measured to be 2056.52 square feet, which is only sufficient for 27 preschoolers at one time. All three outdoor areas do not have sufficient spaces to accommodate the requested capacity. A playground waiver to share the playground at different times in the AM and PM due to limited square footage shall be submitted and approved prior to licensure. Shade is provided via shade canopy and sail shades. There are sufficient outdoor age-appropriate toys and play equipment available on the preschool and toddler playground areas. There is a climbing structure on the preschool playground that appears to be appropriate for children ages 2 to 5 years old and the toddler playground has a play structure that is age appropriate for children ages 6 to 23 months. Both play structures are properly anchored. There is adequate cushioning in fall zones of climbers provided by black rubber cushioning and commercial rubber mats. Drinking water is available via the children’s own water bottles and zippy cups during outdoor activities with portable water pitcher. LPA observed all hazardous items on the playground to be inaccessible to children. Facility representatives was reminded that any changes to the facility must be reported to and approved by Community Care Licensing.
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For childcare center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). Please note that if your building was constructed after January 1, 2010, you are not required to test for lead. However, you must provide proof of the construction date to the regional office.
Facility representative was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.
