25 | On the date and time listed above, Licensing Program Analyst (LPA) Kelly Gerth and Licensing Program Manager (LPM) Pauline Beschorner arrived at the facility for the purpose of conducting a case management visit. The Department received an unusual incident report (UIR) dated 03/27/2024 from the facility, stating a child was left unattended and without supervision for a period during operational hours.
LPA conducted interviews with pertaining parties, and it was found that Child 1 (C1) was playing on the outdoor playground when Staff 1 (S1) and the class began to transition inside, C1 remained outside on the playground. Staff 2 (S2) and Staff 3 (S3) noticed C1 remained behind and took C1 by the hand to bring the child to the adjacent play ground area, notifying the director. Staff was not aware of the missing child and did not notice the child was not present during the transition back inside the classroom. The parents of C1 were notified of the incident, additional training for supervision will be provided to Staff, per the Director.
Based on interviews with staff, it is confirmed that the child was left outside for at least 5 minutes. The facility is being cited for violation of Title 22, Section 101229(a)(1) Absence of Supervision, which poses an immediate health, safety and/or personal rights risk to children in care. A civil penalty will be assessed in the amount of $500 dollars. The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
The Facility representative shall post and provide copies of the report to parents/guardians of the children currently in care at the facility by the next business day and provide copies to the parents/guardians of newly enrolled children at the facility during the next 12 months. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file.
An exit interview was conducted, a copy of this report, 9099D, LIC9224, & appeal rights, along with a Notice of Site Visit were provided to the facility representative, Maria Isabel Gutierrez, on this date and time. |
