25 | On the date and time listed above, Licensing Program Analyst (LPA) Kelly Gerth arrived at the facility for the purpose of conducting a case management visit. The Department received an unusual incident report (UIR) dated 02/10/2025 from the facility, saying a child was left unattended, without supervision for a period during operational hours.
LPA conducted interviews with pertaining parties, and it was found that Staff 1 (S1) found Child 1 (C1), unsupervised in the front lobby sign in/out area located between the white entrance door that exits to the parking lot and black latching gate entrance to the CCC. S1 returned C1 to the outdoor activity space with S2 and the other children, where C1 had originally wandered away from. Per S2’s own statement, S2 had their back turned, attending to another child and was not aware that C1 had wandered away from the playground area. The parents of C1 were notified of the incident, additional training for supervision will be provided to Staff, per the Site Supervisor. Based on interviews with staff, it is confirmed that the child was left outside for anywhere between 1-5 minutes. Staff was not able to provide a narrower time frame of how long the child was without supervision in the lobby/sign in and out area.
At this time, the facility is being cited for violation of Title 22, Section 101229(a)(1) Absence of Supervision, which poses an immediate health, safety and/or personal rights risk to children in care. In addition, this is a repeat violation from 04/29/2024.
A civil penalty will be assessed in the amount of $1000.00 dollars.
The Facility representative shall post and provide copies of the report to parents/guardians of the children currently in care at the facility by the next business day and provide copies to the parents/guardians of newly enrolled children at the facility during the next 12 months. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file.
An exit interview was conducted, a copy of this report, 809D, LIC 9224, & Appeal Rights, along with a Notice of Site Visit which must be posted for 30 days, were provided to the Site Supervisor Leticia Gonzalez, on this date and time. |
