On the above listed date and time, Licensing Program Analyst (LPA) Kelly Gerth made an unannounced visit and met with Learning Jungle Escondido East (CCC) Site Director Leticia Gonzalez to deliver the findings from a complaint made to Community Care Licensing (CCL) on April 01, 2025. The complaint CCL received stated the following allegations: Staff did not properly supervise day care child.

On 04/03/2025, LPA Kelly Gerth made an unannounced visit to conduct investigations regarding the complaint of the above allegations. During the investigation, confidential interviews were conducted with staff members, video footage was reviewed and copies of pertinent records that included: facility roster, pictures, reports, and communication records, and staff disciplinary reports were obtained. Additional interviews were also conducted on 04/02/25 and 04/04/25. Additional evidence was also gathered on 04/02/25.

Regarding the allegation Staff did not properly supervise day care child. Based on the video evidence provided by the CCC, admission statements of staff involved in the incident, as well as the employee disciplinary reports provided as evidence during the investigation, LPA found that the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

California Code of Regulations 101229 (a)(1) Responsibility for Providing Care and Supervision is being cited on the attached LIC 9099D.

Civil penalties in the amount of $1000.00 have been issued, as this poses an immediate health and safety risk to children in care and is a repeat violation within 365 days.

See LIC 421 IM - A plan of Correction was discussed for the deficiency cited.

Licensee was provided a copy of the LIC 9224: Acknowledgment of Receipt of Licensing report and reminded that all parent/guardians of currently enrolled children and those enrolling in the next 365 days from date of this report, must be provided the LIC 9224 form and licensing report. Licensee was reminded the signed LIC 9224 Acknowledgement Receipts must be kept on file.

A copy of this report, appeal rights and Notice of Site Visit were discussed and provided to Facility representative and was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.

By POC, Facility representative agrees that a Regional Administration staff member will submit to CCL, a written plan of strategy to ensure the regulation cited, CCR 101229(a)(1), is immediately met and provide the scheduled date and time of an in person staff meeting and training for all staff on site, which will be conducted by a Regional Administration staff member during the week of 4/28/25, covering the topics of the strategy plan submitted to CCL and the regulation cited.

On 03/27/2025 a child sustained injuries requiring medical treatment, by staffs own admission, corroborated interviews and video evidence, staff failed to provide supervision at the time of the injury.

Regarding the allegation Day care child sustained unexplained injuries while in care, based on interviews conducted, observations and evidence collected, LPA Gerth was unable to corroborate the allegation.

Interviews revealed that an incident did occurred on the date detailed in the complaint allegation report, however all parties involved confirmed that the incident was reported to the parent/guardian and video evidence provided to both CCL and the Escondido Police Department confirmed that the injuries sustained were explained by a witnessing staff. Although not all staff members involved directly observed the incident, the staff that did directly observe the incident did provide detail that matched the video evidence. Therefore, at this time there is not a preponderance of evidence to prove the alleged violations did occur, therefore the allegation is UNSUBSTANTIATED.

A copy of this report, appeal rights and Notice of Site Visit were discussed and provided to Facility representative and was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
