Regarding the allegation Staff did not properly supervise day care child. Based on the video evidence provided by the CCC, admission statements of staff involved in the incident, as well as the employee disciplinary reports provided as evidence during the investigation, LPA found that the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.
California Code of Regulations 101229 (a)(1) Responsibility for Providing Care and Supervision is being cited on the attached LIC 9099D.
Civil penalties in the amount of $1000.00 have been issued, as this poses an immediate health and safety risk to children in care and is a repeat violation within 365 days.
See LIC 421 IM - A plan of Correction was discussed for the deficiency cited.
Licensee was provided a copy of the LIC 9224: Acknowledgment of Receipt of Licensing report and reminded that all parent/guardians of currently enrolled children and those enrolling in the next 365 days from date of this report, must be provided the LIC 9224 form and licensing report. Licensee was reminded the signed LIC 9224 Acknowledgement Receipts must be kept on file.
A copy of this report, appeal rights and Notice of Site Visit were discussed and provided to Facility representative and was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
