On the above date and time, Licensing Program Analyst (LPA) Kelly Gerth arrived unannounced at the facility to investigate the allegation(s) above from a complaint made to Community Care Licensing (CCL) on December 22, 2025. LPA Gerth met with Director Maria Isabel Gutierrez, conducted a tour of the facility, took census and discussed the reason for the visit and the allegations from the complaint; Day care child sustained unexplained injuries while in care and Staff did not properly supervise day care child. At the time of this visit, LPA observed 4 staff supervising 15 children in care.
During the investigation, LPA Gerth conducted confidential interviews with 3 staff members and the reporting party. LPA Gerth gathered evidence pertinent to the investigation including communication records, time sheets, incident reports and photographic evidence.
Regarding the allegation Day care child sustained unexplained injuries while in care. During the investigation, 4/4 interviews corroborated that Child 1 (C1) did sustain an injury while in care at the CCC, however the way in which the child sustained the injury could not be confirmed. Interviews conducted further revealed that although the facility was in ratio at the time, the injuries sustained could not be explained (continued)

by the temporary substitute staff member that was responsible for supervising the child at the time of the incident and that the staff member did give conflicting statements. Although the permanent staff of the facility took action of sending the temporary staff home early, and blocking off the option of the temporary staff as a returning substitute to the CCC, the facility was still unable to explain how the injury occurred to the child but did confirm the injury occurred while in care. Therefore, based on the preponderance of evidence, the above allegation is found to be SUBSTANTIATED.
Regarding the allegation, Staff did not properly supervise day care child. During the investigation LPA Gerth conducted a total of 4 interviews which included the reporting party. Interviews revealed that all staff present during the date of the incident had discussed concerns of the lack of supervision being provided by a temporary substitute staff member and other separate staff did try to step in to aid the classroom due to the concerns. Interviews also revealed that the permanent staff took measures to block off the option of the temporary staff as a returning substitute and communicated this to the sub agency from which the temporary staff was contracted from. Additional staff present the day of the incident revealed that the incident could have easily been prevented had the classroom had proper supervision. Therefore, based on the preponderance of evidence, the above allegation is found to be SUBSTANTIATED.

A copy of this report, appeal rights and Notice of Site Visit were discussed and provided to Facility representative and was reminded that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.

By POC date, the facility representative stated the CCC will present a comprehensive training plan created and conducted by the Regional Director, of the for the care and supervision of children, to CCL for all permanent and temporary staff. The Regional Director will also provide a calendar of dates in which she will regularly be present at the facility to support the site, over the next 3 months, on a weekly basis.

On 12/17/25 a child sustained unexplained injuries to the face while in care of the CCC, which staff interviews revealed to be due to lack of supervision which poses/posed a potential health, safety or personal rights risk to persons in care.
