On the above date and time, Licensing Program Analyst (LPA) Sumayya Habeebulla arrived at Learning Jungle Escondido East Child Care Center (CCC) to deliver the findings from a complaint received by Community Care Licensing (CCL) on April 21, 2026. LPA met with Director Maria Gutierrez and provided the purpose of the visit. LPA toured the facility and took census. It was alleged that Staff yelled at day care children.

During the investigation, LPA conducted interviews with Facility Staff and other pertinent parties. LPA obtained copies of documents relevant to the investigation, including LIC 700 and incident reports submitted by the CCC. Additionally, LPA requested video evidence of the incident from the CCC, the facility provided the footage that was viewed during LPA’s visit today.

Regarding the allegation staff engaged in a verbal altercation in the presence of day-care children. During the investigation, LPA conducted interviews with Staff and relevant parties as well as collected evidence consisting of communicating records and documents pertinent to the investigation. LPA was able to review the video footage of the incident at the facility.

Based on the information gathered during the investigation, it was determined that on April 20, 2026, between approximately 5:00 PM and 5:30 PM, two staff members and five children were present on the preschool playground. During that time, three preschool children entered the infant playground, which was designated as off-limits for preschoolers. Staff #3(S3) was observed attempting to redirect the children back to the preschool activity area. During the viewing of the video footage, LPA observed S3 tugging the arm of Child#2(C2) in order to bring the child out of the playground. A struggle was observed and S3 carried C2 out of the playground. S3 stepped out of the playground with C2 while the remaining two children were observed to be inside the playground. S3 was unsuccessful in transitioning the remaining two children back to the preschool-aged play yard.

While S3 was at the entrance of the infant playground, parents arrived to pick up their children. It was observed in the video the parent of Child #3(C3) arriving first and S3 having a conversation with the parent. The parent enters the playground and successfully accompanies C3 out of the playground. At that time, the parent of child #2 arrived and S3 and Parent #2 are seen engaged in heated verbal exchange while the children were present in the playground. Shortly after the conversation, it was observed that parent #2 leave with their child.

Therefore, based on corroborating interviews, evidence gathered and records reviewed, the preponderance of evidence standard has been met, and the above allegation is found to be SUBSTANTIATED.
California Code of Regulations, Title 22, Division 12: Chapter 1, 101223 (a) (1) Personal Rights are being cited on the attached LIC 9099D.

This is a repeat violation, and civil penalties will be issued.

LPA Habeebulla informed facility representative M. Isabel Guttierez that this report dated 05/20/2026 document one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Habeebulla informed the facility representative M. Isabel Guttierez to provide a copy of this licensing report dated 05/20/2026 that documents the Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child’s file for verification.

An exit interview was conducted with Facility Director M. Isabel Guttierez, a Notice of Site Visit posted, and appeal rights and copy of this report was provided to the facility on this date and time.

Regarding the allegation staff yelled at the day-care children, Interviews conducted corroborated the incident to have occurred as follows; On April 20, 2026 during dismissal time between 5:00 PM to 5:30 PM, three preschool aged children entered the off-limits infant play yard and Staff 3 (S3), who was positioned near the infant playground, attempted to redirect the children back to the on limits preschool play yard. However, additional details obtained during the interview process were contradictory, and LPA was unable to determine whether S3 yelled at the children to exit the playground in a manner that violated their personal rights.

Therefore, based on interviews conducted and evidence received, the above allegation cannot be verified. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the allegation did or did not occur, therefore, the allegation is UNSUBSTANTIATED.
