 On the above date and time, Licensing Program Analyst (LPA) Kelly Gerth conducted an unannounced complaint inspection and met with Learning Jungle Escondido East (CCC) Director M. Isabel Gutierrez and provided the purpose of the visit, to initiate an investigation of the above stated allegation received by Community Care Licensing on June 01, 2026.

During the visit, LPA toured the facility, took census, conducted confidential interviews and reviewed evidence received with the Facility Representative, including written communication and video footage submitted to CCL from the Reporting Party.

Regarding the allegation Staff restrained child in care, based on corroborating interviews, written communication and video evidence received on 06/01/2026, a staff member can be seen in the video footage physically restraining a child in care in the outdoor activity space.

 Therefore, based on review of evidence received the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.

A Deficiency will be issued for CCR 101223(a)(1) and civil penalties have been assessed as this is a repeated violation from the following dates: February 11, 2026 and May 20, 2026.

An exit interview was conducted, and this report was reviewed with Director M. Isabel Gutierrez, Appeal rights were discussed and provided during the exit interview. A notice of site visit was given and licensee understands this must remain posted for 30 days.

By the POC due date, the Facility Representative stated the CCC will implement and submit to CCL a written process for reporting and documenting concerns related to the Personal Rights of Children. Current staff will receive training on the reporting process and children's personal rights requirements. Supervisory staff will review all reports, provide follow-up and corrective action as needed, and maintain documentation to ensure ongoing compliance.

Based on interviews and evidence obtained, the Licensee did not comply with the section cited above in ensuring that the children in care are accorded dignity in his/her personal relationships with staff and other persons when a staff was observed to have physically restrained a child in care, which posed/poses a potential health, safety and/or personal rights risk to children in care.
