On the date and time listed above, Licensing Program Analysts (LPA)’s, Kelly Gerth and Kelli Waters arrived unannounced at the facility to conduct an annual inspection as part of a compliance review. This is a combination childcare center, and the other licensed programs are: 37630052 and 376300053 which were also inspected on this date. A tour of the inside and outside of the facility was granted and the following was observed and/or noted:
· The following items were posted and updated where necessary:
- License
- Emergency Disaster Plan (LIC610) and Earthquake Preparedness Checklist (LIC9148)
- Parent’s Rights Poster (PUB393)
- Personal Rights (LIC613A)
- Child Car Seat Law
- Menu
· The facility is operating within the limits as stated on the license.
· Ratios are being met during this inspection with 15 children present and 4 teachers.
· Classrooms 5 and 6 are adequately equipped with age and size appropriate furniture and equipment, LPA’s observed classroom 4 to lack sufficient age appropriate toys and materials
· There are no weapons present at the facility as stated by Director Maria Gutierrez
· There are no accessible bodies of water present. All wading pools or similar product must be emptied immediately after use and stored in an upright position.
· Drinking water is provided in the indoor and outdoor activity space through the filtered/bottled water dispensed from a water cooler provided by the CCC. Children use their own water bottle/ thermos brought from home.
· Medications are stored where inaccessible to children located in the kitchen.
Hazardous items are stored where inaccessible to children which include disinfectants, cleaning solutions and other items that are dangerous in the locked shed, front office and storage closet.

Poisons and toxins are locked and inaccessible to children
· All floors were observed to be safe and clean.
· Playgrounds are enclosed by appropriate fences but observed to have potential hazards as the childrens garden area was found to have sharp, protruding broken pieces from wooden gardening box and wooden bench.
· Food preparation area is clean, free of litter and rubbish and free of rodents and other vermin
· Food is stored appropriately and protected from contamination
· All storage containers for solid waste were observed to have tight-fitting covers that are kept on, and in good repair
· Sign in/Sign out record was reviewed and meets regulation requirements
· Disaster drills have not been conducted at least every six months – last drill was conducted on 02/07/2024, LPA’s reminded Director Maria Gutierrez of the regulation and Director stated an emergency drill will be conducted before the end of this week.
A review of staff and children's records were conducted as part of this evaluation.
· Children’s records were found to be complete during this inspection.
· Staff record review indicates that all staff present meet minimum qualifications for the position for which they were hired
· A staff member is present with current Pediatric CPR/First Aid which expires on 7/29/25
· Opening and closing staff member’s CPR/First Aid expires on 01/12/24
· Director completed Health and Safety Training 10/26/22
· A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

Director Maria Gutierrez was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.
For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP)
LPA’s verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.
LPA referred Director Maria Gutierrez to the Department website for additional lead information: Lead Toxicity Prevention and Water Testing Information.
This facility provides Incidental Medical Services – IMS. LPA reviewed storage of “medication and equipment/supplies, and reviewed children’s, personnel, and administrative records.
