On 03/25/24, at 9:50am, Licensing Program Analysts (LPA)s Sumayya Habeebulla and Kelly Gerth arrived unannounced at the facility and met with Facility Director Maria Gutierrez to deliver the investigative findings for the above stated allegations. During the investigation, confidential interviews were conducted with staff (S1-S4). LPA also obtained copies of pertinent records that included: facility roster, ouch reports, pictures, Physician’s report, and communication records.

On February 23, 2024, complaints were received by the department alleging Child sustained unexplained bruise in care, Staff left child in a soiled diaper, Staff are not supervising children at all times, Facility is operating out of ratio.

The first allegation is that Child sustained unexplained bruise in care. As per interviews, it was revealed that the staff was informed that C1 had obtained a bruise on the upper thigh. Interviews with pertinent parties revealed that the bruise was not observed during any part of the day, including when C1’s diaper was changed but was eventually noticed by the parent at home. Further interviews revealed that the staff had not observed the child fall or sustain any type of accident but commented that the child walks wobbly and at times loses their balance when the footwear comes off. As for the red mark on C2’s nose, the parent that they inquired about the mark, but staff were unsure of how the scratch happened since it had not been observed by any staff and were only made aware of the scratch at parent pick-up. Staff admitted that the child had been playing on the house play structure right before the parent arrived but were unsure if the that’s how it was sustained.

The second allegation is Staff left child in a soiled diaper. Interviews with pertinent parties revealed that staff change the diaper of every child before they’re picked up. On the day of the incident, C1’s parent had arrived earlier than usual to pick the child up, so staff changed the diaper quickly before dismissing the child and might have not been wiped properly. The parent did bring this to the attention of the facility administration and admitted that it only happened once and has not occurred prior or after this incident.

The third allegation is Staff are not supervising children at all times. Pertinent interviews were conducted with staff but were unable to corroborate allegation. As per the interviews, LPA confirmed that there is one staff with every 4 infants always supervising in the indoor and outdoor areas. LPA confirmed that staff were present and were observing the children, but staff denied that it happened due to a lack of supervision. Staff confirmed that they always have the Facility director stepping in when needed if additional help was required. In addition, at time of inspection, LPA confirmed that the facility was operating within ratio, with 3 staff supervising at total of 9 infants on 02/27/24 and 3 staff supervising 11 infants on 03/25/24.

The fourth allegation is that the Facility is operating out of ratio. During the initial visit conducted by LPA on 02/27/24, LPA observed that there were 3 staff and 9 infants. On the subsequent visit conducted on 03/25/24, there were 3 staff and 11 infants present. As per the interviews, the director stated that the facility does not exceed the capacity and/or ratio limits as stated on the license. In addition, facility staff confirmed that at any given time they never go above the 1:4 ratio and the director always monitors if the staff needs additional help and steps in as needed.

From the information received through interviews with staff, and facility documents the above allegations cannot be verified. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur, therefore, the allegations are UNSUBSTANTIATED.

An exit interview was conducted with Facility Director Ms. Maria Gutierrez, a Notice of Site Visit posted, and a copy of this report was provided to the facility on this date and time.
